Dear Senator/Representative:

During the Conference Committee considerations for the Fiscal Year 2005

Defense Authorization bill, we urge you to oppose Senate Section 3116, providing

the U.S. Department of Energy (DOE) with the authority to reclassify and abandon

millions of gallons of highly radioactive nuclear waste in leaking

underground storage tanks at the Savannah River Site (SRS) in South Carolina.

Approximately 37 million gallons of highly radioactive waste remain in 51

large and failing tanks in South Carolina. Section 3116 gives the U.S.

Department

of Energy (DOE) the authority in South Carolina to reclassify high-level

waste as low-level waste simply by covering the waste with a thick layer of

grout.

The highly radioactive waste would then be abandoned in the aging corroding

tanks that were never designed for permanent disposal and are already leaking.

Given the proximity to the Savannah River and the underlying water table,

the radioactive waste in the tanks represents a serious threat to communities

surrounding SRS and downstream in Georgia and South Carolina.

Section 3116 also establishes a dangerous precedent providing DOE with

leverage to pressure Idaho, Washington, and New York to accept reduced cleanup

at

their high-level waste tanks, which are also old, rusting and in many cases

leaking, posing grave risks to the Columbia River, Snake River Aquifer and Great

Lakes.

The DOE lacks a mandate to move forward with their reclassification plan.

When Section 3116 was voted on in the Senate, it drew a tie vote surviving by

only the narrowest of margins. The House did not approve of a similar measure

in

its Defense Authorization bill and the House, in the Energy & Water

Development appropriations, explicitly rejected state-specific solutions of the

kind

present in Section 3116.

It should be noted that Section 3116 is a direct legislative reversal of a

Federal District Court case that was decided in the summer of 2003. An appeal to

that case is currently pending before a United States Circuit Court of

Appeals. Section 3116 would partially interfere with that pending case prior to

the

Court of Appeals having an opportunity to rule on the matter.

The affirmation by both the House and the Senate to have the National

Academies of Science (NAS) examine the high-level waste issue in detail is a

safer

course of action, considering the serious nature of the threat. Nor would the

NAS study in any way interfere with the current legal matter under review in the

Court of Appeals.

Cleanup of the all of the high-level waste tanks must continue uninterrupted

with full funding. We urge support for Senate Section 3120 to fully fund $350

million for ongoing cleanup of the high-level radioactive waste tanks in

Idaho, Washington, and South Carolina.

Again, we urge you to strike Senate Section 3116 providing DOE with the

ability to reclassify high-level nuclear waste in South Carolina and to support

Senate Section 3120 providing full funding for ongoing cleanup of the waste

tanks

in South Carolina, Idaho and Washington. We hope that you will do all you

can to spare the residents of communities next to DOE nuclear weapons complex

sites from facing the risks of these inadequate cleanup policies and to stop

such ill-advised plans from being adopted at other DOE cleanup sites.

Thanks for posting. Relieved Charlie's seizures are down. Hope the

surgery goes well.

Methods

now being employed are not obviously working yet.

Surgery is scheduled for Thursday, but Charlie may decide to postpone as the

survival rate ain't so different. Big decisions for a developmentally

disabled person to make. But it is his life and his body. All I can do is

provide

options and support...... etc. and 'woman' the MomMobile. These days it's a

1989 station wagon with a CharlieNest in the back as he's too weak to travel

much distance sitting up.

But, the good news remains.... seizure free since December... through surgery

on 30 June and without Lamictal 30 hours post surgery.

On Friday, an important article ran in the Des Moines Register that

brought our attention to a significant development. We have issued an

ACTION ALERT in response.

ProdiGene Inc. has requested permission from the U.S. Department of

Agriculture (USDA) to grow corn in Texas genetically engineered to

contain two pharmaceutical components -- aprotinin and trypsinogen.

The USDA's Animal and Plant Health Inspection Service is requesting

public comments, but they must be submitted no later than Tuesday

night, August 10th.

The Campaign to Label Genetically Engineered Foods feels the threat

to the food supply from these so-called " PharmCrops " is so serious

that we have established a separate PharmCrops web site at:

We have set up an ACTION ALERT on the PharmCrops web site so you can

instantly send comments on ProdiGene's permit requests to the USDA's

Animal and Plant Health Inspection Service at:

www.pharmcrops.com/prodigenealert.php

Since there are actually two permit requests pending from ProdiGene --

one for aprotinin and one for trypsinogen -- you will want to send

two of the nearly identical messages to the USDA. And you can add

your own comments if you desire.

While you are commenting on the ProdiGene permit, you may also want

to send e-mails and letters to your members of Congress on these

risky crops. Legislation has already been introduced into House of

Representatives by Representative Dennis Kucinich to prevent these

crops from being grown in outdoor environments and in food crops. The

bill is H.R. 2921, the " Genetically Engineered Pharmaceutical and

Industrial Crop Safety Act. "

My son is in the Atkins Diet Research Program at Hopkins. Since there

The New York State Assembly and Senate have passed a bill to Reform the

Office Of Professional Medical Conduct. The bill provides for granting doctors

the

elementary due process rights to know the elements of the issues under

investigation.prior to the first interview. It structures an opportunity to

settle

and remediate the dispute prior to the time comsuming adversarial proceedings

begin. The department must disclose in advance, the names and expertise of any

witnesses it will present and any exculpatory evidence it has discovered in

its investigation must be revealed to the doctor. It provides for the admission

of scientific and medical literature as evidence which is now rarely admitted.

When the bill is sent to Governor Pataki, he will have ten days to sign or

veto the bill. If he does not act the bill will become law without his

signature.

Please call write or Email Gov,Pataki asking him to sign OPMC Reform A 4274/S

4148 to assure due process rights for Alternative Medical Doctors who have

been unfairly treated in recent years. Many of the best alternative medical

doctors in New York State are no longer practicing under current law Dr.Corsello

and Dr.Carley had their licenses revoked and Dr.s, although her medical

license was restored, cannot obtain malpractice insurance, and is not

practicing medicine.

NEW YORK (Reuters Health) Aug 20 - During pregnancy, increased lamotrigine

clearance may lead to worsening of seizure control, Dutch researchers have

found. Dose adjustment during pregnancy may then lead to toxic side effects

after

delivery.

Little is known about the pharmacokinetics of new anticonvulsant drugs during

pregnancy, note Dr. G-J de Haan, at the Epilepsy Institute of the Netherlands

SEIN, Heemstede, and colleagues in their report in the August 10th issue of

Neurology. In previous reports of increased lamotrigine clearance in pregnant

women, altered pharmacokinetics may have been influenced by the use of

concomitant medication.
