I think it’s just semantics and a

social security worker calling it “welfare” is awful in my opinion.

In NY, “welfare” is not called

welfare and you apply at Social Services which is a state run agency.

Social Security is federal.

What is Supplemental Security Income (SSI)?

Answer

The

SSI program provides monthly income to people who are age 65 or older, or

are blind or disabled, and have limited income and financial resources.

Effective January 2008 the SSI payment for an eligible individual is $637

per month and $956 per month for an eligible couple. If you are married,

and only one person is eligible, a portion of your spouse's income may be

counted. In addition, your financial resources (savings and assets you

own) cannot exceed $2,000 ($3,000 if married). You can be eligible for

SSI even if you have never worked in employment covered under Social

Security.

Generally,

to be eligible for SSI, an individual also must be a resident of the United States

and must be a citizen or a noncitizen lawfully admitted for permanent

residence. Also, some noncitizens granted a special status by the

Department of Homeland Security (DHS) may be eligible.

For

more information, you may want to read our publication called SSI (Publication No. 05-11000).

You may also want to read our introductory material in the booklet, Understanding SSI.

When I applied he wasn't working , but I did notify them as soon as he was . I was not covered for the first 90 days of his employment .

[Hepatitis_C_ Central] Soc Sec Medical Exam

I am scheduled for my medical exam by the social security doctor on Monday. I’m nervous and was hoping someone who’s lived through it can give me a couple of tips.

I am basing my claim on rheumatoid arthritis, peripheral neuropathy and I’m throwing in HCV, cryoglobulenemia, herniated discs, Reynaud’s and glaucoma for good measure.

If I don’t get it on this first go-round, I don’t know if I can afford to support myself for the length of time it will take for an appeal so it’s now or never!

The system sucks!

I e-mailed the paralegal I’ve been

working with to let her know the exam was done this morning and that I wasn’t

confident that I’d be approved. She replied that it’s common to be

denied and to have to appeal – the wait to go before the judge is approx.

18 months.

Looks like I’ll be registering with

a temp agency.

My husband was told the same, Dorothy, and it is common

to be denied the first time, though he got lucky and it

went right through.. I sure hope you get lucky, too.

If not, I would really consider using a different attorney,

and no, Imho, they are not all created equal.

My best to you!

Sheena

Interesting. Did you do all of them at the same appointment or were they on separate occasions??

It should be the same everywhere since social security is federal.

I sure hope I don’t have to see a rheumatologist AND neurologist.

Well, I don’t know that the attorney

has any influence on the final decision. I guess there are different ways

of filling out the forms, but I don’t know that I’d be better off

with a different attorney. At this point, all they do is file the

application. What do you believe one attorney can do that another might

not?

I sure hope that I luck out like your

husband and mine goes through as well. I’m hoping that there is

more weight placed on what my doctors say in their reports than what this

doctor says. I have a copy of my neurologist’s report and he

states, “Totally and permanently disabled” so you can’t be

more clear than that.

This attorney was recommended by my

neurologist and has represented many of his patients. He assured me that

they have a high success rate and I truly don’t believe that any of the

attorneys take cases that they don’t feel have a good chance of winning.

Thanks, Sheena

I think SS

takes your claim more seriously if an attorney has agreed to represent you.

After all, they don’t get paid until and unless you are approved.

I agree – although they don’t

much else but fill out forms, they still don’t want to waste their time

on case they won’t win.

I took my neurologist’s

recommendation for an attorney because he deals with this on an ongoing basis

and I’d be doing little more than picking someone out of the phonebook.

I was suggesting getting another only if you were denied,

especially since you seemed not at all happy and more

than concerned with the paralegals reply.

I do hold to not all fighting as hard for you, but whatever..

It really does matter what forms are filed, and when..

Sure glad you are satisfied with the attorney that you have,

half the battle. Again, I do wish you a speedy win!

Yes, I wasn’t happy with the paralegal’s

reply, but she was telling me the way it is – this is what I expect from them.

I’m not being misled into thinking that I could have a resolution to an appeal

I’m actually not dissatisfied nor am I

satisfied. It’s just the way it is.

Dorothy, I can speak from experience about this because had I NOT made that appointment with our local attorney who ONLY specializes in ssdi cases, I would have gone to that mandated/ordered appointment to that doc who works for the state and she might have not agree'd with my docs and that could have cost me my continued ssdi. As I said, an attorney who specializes in only ssdi knows all the rules and how the system works. The case worker who was re-evaluating my case was threatening me if I didnt go, and had I not gone to that attorney, I probably would have been intimidated by her and would have gone and as I said, it 'could' have been disasterous for me financially.. This attorney also told me about the law that no one else told me that if I turned 50 years old while being on ssdi and they re-evaluated me , that they could NOT force me to EVER

take a desk job unless I had worked at a desk job previously, which I had not.. So there are little things that an attorney who does not specialize in ssdi might not know or may not remember etc,, so I believe that its very important that you see one who specializes in ssdi.. and you can't take everything the paralegal says as truth either.. It would be nice if our justice system was really fair for everyone, but unfortunately we have now grown a special group of justices and judges who think they can change the rules from the bench... so anything is possible and what we thought was a sure bet before no longer is... I didnt need to see him before that as I was already being represented by alsup which is just like bender and bender. My last employer had it all set up with Alsup as a paid benefit for those who needed to switch from company long term disability to the federal SSDI program. Alsup refused to let me give up, they kept appealing my case and they actually went to the hearing with the judge on my behalf, I didnt even have to appear.. they gathered all the info needed and made sure that the paperwork was done properly with all the t's crossed and all the i's dotted so to speak.. But with my final approval, the judge wanted to reevaluate me in 18 months and thats when I went to see this attorney in this town we now live in... the state was going to send me over an hours drive in a car to see their doc.. He is the one who really helped me to

stand up for myself and demand that THEY FOLLOW the LAW and stop harrassing me..I surely hope you get yours the first time,, I really do.. I wouldnt wish that kind of harrassment and frustration on anyone hon..IM keeping my fingers crossed for you!Jackie
