Federally tax-exempt organizations classified under IRC sections 501© or

501(d) must comply with the recently revised law and regulations addressing

public disclosure of certain forms and associated materials they've

submitted to the IRS. These include any annual information returns whose

required or actual filing date was within the last three years, which

generally means the three most recent returns. These annual returns use Form

990 and its variants for 501© organizations, and Form 1065 for 501(d)

organizations. If the organization filed its application for tax-exempt

status (e.g. Form 1023 or 1024) after July 15, 1987 or possessed a copy of

its application materials on that date, it must also make copies of that

application available to the public. All schedules, attachments and other

supporting material submitted with the annual return and application must

also be disclosed, with exceptions noted below.

Public access must be provided promptly on request by allowing inspection of

the documents at the organization's office or offices, and by providing

copies of the documents promptly in response to any in-person request or

within 30 days for a written request. However, organizations don't have to

provide copies if they make these materials widely available through

publication on the Internet, or if the IRS determines that the organization

is being subject to a harassment campaign. The organization is permitted to

require a payment in advance for actual postage costs incurred, and a

copying fee of up to $1 for the first page and $0.15 for each page

thereafter. The request may be for only certain documents, or only certain

portions of documents, in which case the charges must be for only those

pages. NPO staff members who fail to comply with the new law and regulations

are personally subject to fines and other penalties (i.e. the person

refusing to provide public access gets fined, not the organization).

The law allows certain information to be excepted from public disclosure.

However, other than this specifically excepted material, all schedules,

attachments and other material associated with the annual information

returns and application for tax-exempt status submitted to the IRS must also

be disclosed, as must any letter or other document issued by the IRS with

respect to the application.

BTW, the information I'm asking for is PUBLIC information, I guess

I'll just have to research you... that is, if you're legitimate.

Thank you for your comments I am trying to keep cost down and more of our

donated money going to the mission not my pocket I work a full time job and

every one that helps volunteers to help me! we are not big and working on

our first year I want this to be as simple as I can make it for all of us. I

just got word that someone is donating the cost to build and maintain a web

site so here in a few weeks I hope to have it up and running.

I am not one to pass judgement on anyone but coming from a

professional marketing and legal background and working with start-

ups for over 14 years (and being an EMT - don't have to chase 'em

cause I can drive 'em) I too have seen the posts from Wind Foundation

recently.

Just my two cents but if Wind Foundation is attempting to garner

business and truly help, I think a much better approach would be to

have your business plans in order first. Having a website with the

appropriate public documents, a description of what you do, success

stories, background, personal information/education, and experience

in grant writing would be a better way to start. This would be

helpful and probably lend more credence to your company than what has

been posted as of late regarding your organization.

I think it is a noble attempt and many organizations could probably

use this type of assistance. However, I am a bit skeptical about your

organization and would be unwilling to engage it based on

your " ability to help " without some type of formal information that

can be reviewed first.

I hope I have not offended anyone with these comments but some times

my opinions get the best of me.

So, having had time to do research, here's what I've found:

Gegeny's resume is at

http://64.233.167.104/search?q=cache:3dU4rGyfs_kJ:www.centerforaids.org/tomg/res\

ume/resume1.pdf+%221205+banks%22,+houston & hl=en

That's google's HTML representation of hsi PDF resume. It's fairly impressive.

seems to work for AMWA. , do you know much about AMWA?

Being a medical writer, maybe you have some insight here.

also seems to be published on the aspects of setting up web

sites. Makes it seem very strange that for someone published on web

sites, a charitable foundation he's associated with can't seem to

produce one and doesn't seem to recognize the value of one.

also seems to be missing from this email thread. Instead, we

have JC , who's using ' name in his email header. JC is

less articulate with his words and less careful with his spelling than

one would expect a grant writer to be, so one must conclude that he's

a " front man, " much like a used car salesman or a carnival huckster -

someone good at getting attention adn drawing a crowd.

Then we have the WIND foundation - which appears to be using the

address of the AMWA. It's registered board members are:

DIRECTOR CLINT CARLIN

715 SPENCER HIGHWAY

SOUTH HOUSTON , TX 77587

DIRECTOR J C SIMMONS

1205 BANKS

HOUSTON , TX 77006

DIRECTOR KEVIN WHITTON

P.O. BOX 524

HOUSTON , TX 77001

Neither Clint not appear to have EMS certifications in Texas, as

listed on CertQuery. Julius C , of Houston, is a recently

renewed EMT-I.

So, what do we have? A startup organization with no real public

presence asking list members for financial details on their respective

organizations, and posting in a less coherent manner than one would

expect a grant writer to post with, co-sharing an address with the

AMWA, and using the name of one of their apparent writers.

Could it be that this is an attempt to garner business for the AMWA?

Maybe attract EMS agencies and get them to pay for grant writing

services, or give up a part of their grants? What is the motive here,

and more importantly, how does it really work?

Mike :)
