The gay scoutmaster may have taken a weak tactical approach with the " BSA is an org. of public accomodation so it can't discriminate " stance. Perhaps it would be more fruitful to sue BSA for damages (emotional distress, etc.) for their arbitrary expulsion and defamatory labeling of this fine, dedicated Scout as " immoral " and " unfit to be a Scout/Scoutmaster " , when the day before they saw the picture of him at the gay students' group, they had nothing but accolades for him. ~Rita ------------------------- << Just one note on the Boy Scout thing. From what I understand, a challenge similar to this one was dismissed because BSA is a private organization and is free to exclude those it chooses to. But this time, the court's thinking is that BSA is an organization of " public accomodation " . I tend to agree with the idea of being a private organization. I wouldn't want the courts telling me who I have to hang around with in my private life, and I feel that if BSA wants to be bigoted and hateful, that is their right. Unconditional liberty, the right to do what one wishes regardless, would be anarchy. Therefore, if someone violates the condition, they have forfeited their liberty.
