Guest guest
What state are you in? Usually, if it is worker's comp related, you have the right to a second opinion. After a certain amount of time has passed (I believe it varies by state), you even have the option to get a second opinion from a doctor who is not on your worker's comp panel, and the employer must pay for it. and the gang -- jacdobe@... Guest guest
Depending on the state you are in, you may be allowed to go to a doctor OF YOUR CHOICE for a second (or in this case, third) opinion. You have to do some research for your state and the worker's comp laws to see what your rights are. If your rights are being violated and you cannot work, you may have to get legal advice. and the gang -- jacdobe@... Guest guest
If a cancer patient can hold a Doc responsible for misdiagnosis and failire to treat as well as unecessary pain and suffering, why not someone like us? After my first fusion I had MORE pain but no other tests were ordered,I was told all I needed was PT and basically denied meds for pain control. After having a follow up MRI,CT and myleogram,it was found that I had much more extensive problems and required redo of prior fusion after 14 months as well as corpesctomy, titanium cage and 3 level fusion. Docs should be held responsible for ignoring symptoms as reported by patients as well as witholding treatment and pain control.Period. Guest guest
Suzy-I agree with Deb, you can sue, BUT were the problems on the next MRI on the first MRI or were they problems that developed after your initial surgery? You need to do it within the statute of limitations which is usually two years in most places. If you do research on the internet you should be able to find the criteria that the doctor must meet in order to bring a malpractice suit against him. Do you know that it is something that the doctor reading the MRI and your surgeon both missed on the first MRI? What did they tell you the reason they had to do a 2nd operation? I assume the first surgery was a fusion? You said you have seen two doctors? They both now agree? Or one disagrees with the other now? Was one a doctor that YOU chose? - I went through over 5 years before doctors finally even admitted anything was wrong with me. They kept shoving antidepressants down me and I was almost to the point of being paralyzed because my doctors were idiots. Thank God I finally talked to an intelligent P.A. and NOT the doctor. I did whatever the doctors told me to for a very long time, I even let them convince me that it was " all in my head " and I honestly thought I was nuts. Now looking back it makes me so angry I could chew nails. This is my body and I KNOW when something is wrong and doctors WILL listen to me now or I find another doctor, hospital, etc. Never, ever again will I let a doctor dismiss me when I know something is truly wrong. If both doctors have been ortho's have you thought of seeing a neurologist to get your other opinion? I'm sorry you are so frustrated. Guest guest
Another question Sue, Your doctors say you have S.I. Dysfunction. What is causing that? Age? Weight? Do you know? If there is anyway you can afford it you might could try water aerobics to build up your core muscles to get some relief from your S.I. pain. Guest guest
Barb,All I was told on the first one was that I had lost disc space and needed a fusion at cs and c5. The pain never stopped,it kept getting worse. Each time I went back I complained. They did a couple of c spine xrays but no post op MRI or CT.I finall got pissed at the PA,I told her the pain was unacceptable. She sent me to someone else in the practice to get trigger point injections. This Doc did about 3 of thos and then said, there,s no point continuing these, they aren,t working. She suggested I get a tennis ball and lean against a wall to massage myself. My mouth fell open. I finall wnet to a PM Doc,she did an MRI,she saw a huge overgrown facet at c5 and a herniated and extruded disc at t10. She tought the fusion at c4 and 5 looked ok.She did injections,r sets, they didn't work, she did them under sedation and the copays were killing me and the pain was as awul as ever.I told her I was going to see a Neuro and she got pissed. The neuro did CT and mylegram. He referred to me in a kidding way as " a problem " He showed me the films, the facet at c5 was huge, the bone at c6 was crumbly looking, and it was as plain as could be on the ct,that the fusion from last March had failed, you could see the crack in the fusion. Then there was the problem at T10. The last surgeon continued to tell me I'd be fine, fusion was healed, just need a little PT,good as new. So,this May, exactly 14 months after the first surgery,I had 3 level fusion, corpectomy, placement of cage and hardware. I'm better, but I went through a year of pure hell,my marriage fell apart, all I could do was drag myself through a work day, nothing more, not shopping, church, going out to dinner,no Grandkids,no friends, nothing.I came home from work everyday and sat on the couch and cried because the pain was so awful. It is so wrong for Doctors to ignore patients. It almost seems immoral to me. Not to address the pain and outright suffering. I should talk to someone. Thanks Barb,Deb. Guest guest
Thanks for all your replies. Well today I went into work and start back August 7th. Was at my store for 1 hour walking around etc. Came home and slept for 3 hours, exhausted with pain. I am 51 and 125lbs - so the weight issue is not an issue I guess. I will have to work 3 - 10 hour days - my mind boggles - how I will do this - I will cross this road when I am there. Stupid Dr - gave me a script for Voltaren gel - just been looking and it says it has never been evaluated on the SPINE for use?? and the warnings are bad - as I have had High Blood pressure for 25 years - was under control until I hurt myself - and my primary care Dr has had to triple medication - guess its my body saying can't deal with this - thanks again and anymore thoughts etc would greatly be appreciated - does or has anyone used Voltaren gel with High blood pressure on there tailbone. Guest guest
Voltarin gel is fabulous but can't see that as the Only painedicine.......it works in combination with pain meds well. The fact that ur bp is high is enough of a reason to treat ur pain. I would suggest seeking the help Of a pain management dr. Guest guest
Statute of limitAtions is 2 years from the time you shouldnhave known there was a problem which is NOT two years after surgery. It's when a dr first tells u hey there is a problem. My ex had a corpectomy fusion and cage at c3 thru c6 And has done fabulous. He was in a collar for 3 months and used a bone growth stimulator for 6 months and is pain free now off of all narcotics. Trigger point injections for a facet joint? What about ESI in the facet or a rhizolysis which gave me a lot of relief. My marriage fell apart (17 years) when I got sick As well. He would be angry when I couldn't work.....funny now paybacks are hell as he has discovered how unpleasant back pain can be... Guest guest
It's amusing (not in a good way) how so many of us lost our marriages during the process of this horrid pain and health problems. I had been married 21 years and lost mine too. Pretty much lost everything. Oh well, you pick up and move on the best you can.
