THANKS, Alan...you kick ass buddy! I appreciate your support more

than anything.

I will not give up, and I understand hope is not a bad thing. When I

wrote earlier I literally just got the news. I was

down/bumbed/pissed off for about 2 mins, then had to get back to work

(reality). Not to mention? Wanna know my true perspective and

inspiration the past week or two? Not to reveal a true tear jerker

(I cry just thinking about it)...but here goes nothin'. There's an

amazing person that I work with that comes to work every day to do

his deal...and he's dying. Yup, dying. Some might say, " Why the

hell does he still work? " 'Cuz he loves it...he's fighting...and

he'll continue to fight...hard. The sad thing? I barely knew this

guy a couple months ago...but in such a short period of time, he's

given and offered so much just bein' in the office. Talk about

perspective. Today I thought, " I " m havin' a bad day? " Give me

fuckin' break (excuse my french all).

I shall move on...and I shall be whole again. In fact, De Smet's

lookin' better and better every moment...and hell, I haven't been to

Europe in 8 years and I have spent quite a bit of time there in my

college and post-college years! May just be God tellin' me it's time

for a trip. Time to up the investigation.

I have BCCA and I've been there. Your story has rekindled all my

emotions when I was denied– bitter anger, resentment, deep

disappointment, fear, depression and confusion. It's tough, but

it's not the end of the world. You now have 5 options: (1)you

can appeal, (2)you can take legal action, (3)you can wait for FDA

approval, (4)you can pay out of pocket, or (5)you can have

's large head metal-on-metal THR as it is FDA approved.

Re: option 1 - I appealed and was denied and JRI says no BCCA appeal

has been successful, so not much hope for this. I even appealed the

appeal denial to the state with no luck.

Re: option 2 - I'm in a group plan, and as such, am not eligible

for the class action lawsuit under Fleitman. I found a

couple of attorneys in SoCal specializing in insurance that were

willing to take my case and can give you their names. The problem

here is the case could easily extend beyond the anticipated time of

FDA approval.

Re: option 3 – The educated guess on approval is early in 2005.

Before you decide to wait, I suggest you get a JRI surgeon's

opinion on whether your hip could, or will likely deteriorate too

much in the meantime to be eligible for resurfacing. My OA was

diagnosed in 1979 and I waited 18 years for an alternative to THR for

my first hip. (and BCCA paid for it then). I waited 2 years after the

BCCA denial for my second hip and it was almost too far gone for

resurfacing. (Another reason to go with the most experienced surgeon

you can find.)

Re: option 4 - $17,500 (JRI's cash price) is still beyond the

means of many of us. You can compare prices in Belgium, but India

certainly has the lowest according to info on this site.

Re: 5 – a personal decision that only you can ultimately make.

As Alan says it's not you. You still have some cards to play.

India....I hear the Dr's were trained in England and they are FAR,
