Dont dress up......... I want the Judge to see you as you normally look every day around the house. Women shouldn't wear finger polish. It may just be my superstition, but women wearing fingernail polish always seem to lose. Take meds as u normally do b4 the hearing. Do not double up no matter how nervous u are unless your dr tells you to. At your hearing listen carefully to the questions asked. If you don't understand one, ask that it be repeated or explained . Answer the question fully and completely. Answer only the question asked you. If I ask you about your legs, don't start telling me about your problem with your arms. If you don't know the answer to a question, say you don't know. If you don't remember, say you don't remember. Speak up at your hearing so that you can be heard and understood. If a relative or friend comes with you to the hearing, you should tell them not to answer questions for you when you are testifying. Even if you cannot remember or answer incorrectly, they should not butt in. Don't try to put on a brave front at your hearing, they are not handing out awards for bravery. If it hurts, testify that it hurts. If you can't do something, testify that you can't do it. You can't expect a fair decision from the Judge unless he knows what is wrong with you. Don't exaggerate your problems at your hearing. This can hurt you more than anything. If you need to stand up or walk around during your hearing, do it. You don't have to ask my permission or the Judge's. Just do it. Remember that if you testify that you can only sit for 15 min at a time and then sit in agony through a 45 min hearing, the Judge will think that you are lying. Your hearing will be before an Administrative Law Judge who works for Social Security and hears only Social Security Cases. Social Security won't be represented at the hearing by a lawyer. There will be no jury or spectators at your hearing. Unless I tell you otherwise, the only people there will be me, the Judge, the Judges secretary, you and any witnesses and friends you bring with you. The hearing will last from 20 min to an hour. The judge won't announce a decision at the hearing. We will get it in the mail two months or more after the hearing. Call me when you get the decision. If you have to be admitted to the hospital or some other major development occurs regarding your health while we are waiting for a decision in your case, please let me know as soon as possible. If we win, you won't be paid until one to three months ( and sometimes longer ) after we get the decision. You should call me when you get your first check. Ok now after all that , who wouldnt be nervous......... and also another question here............... who has went through this........ did you have a vocational expert......... and did you take witnesses......... should I take witnesses and if so how many............ and who? Me neervous nahhhhhhhhhh........... yikers, im nervous as all git out. If they can't base a judgement on facts, then who is this country can we trust?? I guess I know the answer to that. I hate to think it's come to this kind of stuff, but I know it has. I just think it stinks! I've always been too trusting of people, but I DO know there ARE SOME good, honest people in this world - this list is evidence of that!!! Unfortunately, sometimes it seems as if our government has gone alittle nuts and you have to " jump " thru hoops to get them to pay attention. Just do whatever you have to - as much as we don't like it, sometimes we have to " play the game " . Take care and I hope everything does smoothly for you.
