I am new to this forum and i just wanted to say hello. I am suspose

to be having surgery on the 28th but my boss said that it wasn't

convient for her for me to be off at that time and i will have to

reschedule. Ok problem. My husband wants me to just tell her ok and

work up until my surgery and then quit the night before. Also the

next time i can have my surgery is dec 19 and then jan 1 our insurance

changes and it doesn't cover my surgery any more. So my husband is

afarid that something may happen on the 19 and then i won't be able to

have my surgery at all. I don't know what to do.

Your boss cannnot tell you you can't have surgery if your dr has stated that is

it necessary. It is not up to your boss when you are having surgery. Call your

HR at you job.

Your boss can not tell you to reschedule surgery for her convience.

Your surgery is cruial to your life. I would talk to her one more

time and tell her, Nov. 28th is when your doctor has you scheduled

and your insurance will not pay if you don't have it now. You really

don't have to say anything to her except I have surgery scheduled and

advise of the time you need off. If she still gives you a problem.

Then go talk to her boss or like said, the HR Dept. and don't

quit. If they fire you over this. You can drawn your unemployment and

sue the ---- at of them. Just my opinion. Hope it all works out for

you. Keep us posted.

I say have the surgery and tell your boss that you have scheduled it and that

you are sprry that it is not a good time for her.

Don't quit - you need the insurance. If you scheduled with enough notice - you

should go to your HR Department. See if you can get your doctor to defend your

decision...

surgery after the first of they year and they are STALLING on you.

RUN, RUN, RUN to the hospital and tell your boss to stick it.

First thing Monday moring though, find out and MAKE SURE your employer

does fall under the FMLA regulations, this does NOT matter what state

you are in, this is a federal thing thanks to the first BUSH

president. Go for it!!!!!!

I think we already had some postings on FMLA and employers/bosses

forbidding or tryint to interfere with surgery dates. I think it came

down to an issue of giving suffecient notice to the employer (30

days). I can understand that concern here over complications and

insurance not being available for them in this case except that those

same complications could occur two months after surgery on the 28th

too.
