Individual cases of malpractice can, of course, be brought to action...but that wouldn't (hasn't yet, anyway) move a mountain of history nor would it motivate 40,000 other gyns to sit up and take notice. Been to the ACOG website lately? They are all about CYA. Check out their pages recently put online in regard to informed consent, their position statement and press releases on the hysterectomy and alternatives, etc. They've done due diligence -- in the 'public eye,' that is -- towards being legally without any liability whatsoever for anything a single (or the masses) of ACOG members choose to do " out there. " So, if you want to get docs to sit up and take notice....who do you sue? Where does the class action lie? Insurance providers? Other medical professional groups? (hmmmm....the One Kilo Club is one I'd like to see taken " down " a notch....) Medical schools? (Just what ARE they teaching docs these days....)....
