Guest guest Posted January 29, 2005 Report Posted January 29, 2005 - I don't recall IDEA changing in that respect. Regression still is the touchstone for ESY as far as I know. If the district is giving your friend a hard time, I'd suggest she ask them for the language in the new statute that says what they say it does. At least she'll have a better idea where they're coming from and she can consult with an attorney (something she should not be hesitant to say even under the new rules regarding attorney fees that can be recovered from a parent). I am trying to help a Mom who is being told that the rules changed and regression and trying to close a gap is not a good enough reason to qualify. Sounds like bull to me but I know there was some changes in IDEA so I am trying to give them the benefit of the doubt. denise Quote
Guest guest Posted January 30, 2005 Report Posted January 30, 2005 , I agree with Sherry. To add to that, the new (crappy) law doesn't take efect until July 2005. So i woudl think that the school has to base their deciosns on the current IDEA - IT AIN'T GONE YET! Your friend coudl ask for a " letter of prior written notice " as to why the school feels her child dones't need ESY. Tricia Morin North Carolina > > - > I don't recall IDEA changing in that respect. Guest guest Posted May 12, 2005 Report Posted May 12, 2005 Hi everyone I need to ask about ESY for my son,(severe apraxia & other develop. delays), currently he is getting speech therapy 3xweek on one to one basis, OT & PT once a week in school. Today I was told that for the summer program(for 5 weeks,I thought it will be whole summer long) he will be getting spech therapy in group not individually. But I know that he needs it individually,I have called his school and told them what I think and witing for their reply. any suggestion please thanks Archana Quote
