I hate to burst anyones bubble about being fired while one w/c but I know of dozens of people this has happened to!!!! One close friend had to be taken to the hospital by ambulance from her job injury and she had a very well paying job!!!! after 2 years they terminated her job. After doing alot of checking we found out it is quite common. This was over ten years ago. My rsd came from a stupid Drs mistake so I got nothing but paid my own money until it ran out and social security disability until 65 now regular SS My check went up after I went up to regular ss. But yes u can be fired while on w/c Margie in NC

Donna,

I have no idea how they can terminate you if your injury is a result from your job. If you are collecting workers compensation and receiving checks, I believe know matter what state you live in they can not do that. Did any of your doctors that you are treating with, tell them that you can go back to work? If the doctors did not release you back, then you should be getting your benefits and being paid. Did you see one of WC doctors? If they say you are fine, which most of them will, that is what is causing all of this to happen and you most definitely need an attorney!!!! If they stopped benefits, you should make sure that you are going to receive a check this week, because they may stop that if they are terminating your employment. I do not want to upset you, but I went through all of this when I went and saw one of there doctors, who said I was 0 percent disabled and had a tear in my knee and needed surgery again for the

second time when I saw him. He even had the MRI in front of him that showed another tear! Again Donna this is all about money for them, and I know you are at wits end, but that is what they are striving for. I have been told by so many people that they just push until you give up, that is there goal!!! Get a good attorney and they will aliviate so much of the nonsense for you. It is a good idea to get your doctors to write letters for you, but the only thing that will really help you now is an attorney!! Take Care and I am Praying and Wishing you all the Best! Its only been 3 months that I've been out can they do this on such short term without even notifying me and giving me a chance to fight back? I live in Massachusetts so I know the laws are different. At this point, I dont want to go back to work for them BUT I do want coverage for my family as far as insurance goes, if it were just employment its wouldnt bother me but health insurance is vital!Any suggestions?HugsDonna

Hi Dawn

I was working at wal-mart,when I got hurt,after that they had me be a door greeter,but then when x-mas was over, I was let go, even though I was still able to work on limited duty.and I don't think they will hier me back, because I am taking they to court.

What was the reason they gave you when they let you go, and how long had you worked for them? Also did you have an attorney when you first got injured? Not having an attorney immediately is the biggest mistake that most of us make! We all assume that our company will treat us fairly and with respect, but that is not the case at all! They really do not care about us and only have dollar signs in there eyes!!!! I cannot get over how similar so many of our stories are, yet I find it very hard to believe that we are all commiting fraud!! You know that is what everyone of our employers and insurance carriers think. I wish there was someway we could all get together and go see Mr. W. Bush!!!!! I would really tell him what I think of health care in this country. It almost makes me want to move to New Zealand where everyone gets the exact same care!!!!!! Thank you for the information. I was unaware that they are supposed

to hold my insurance for 1 month after termination. That makes me

feel a little bit better (not much) but with all this going on I need

to make alternative arrangements and it wont happen overnight. Thanks

again for the research Tricia!
