DWI Blood Draws

H.B. No. 14, Corte

Is anyone aware of the supporters of this piece of legislation that

has been filed for the 79th session?

Draft text:

Sec. 724.017. TAKING OF BLOOD SPECIMEN.

(a) Only the following may take a blood specimen at the request or

order of a peace officer under this chapter:

(1) a physician;

(2) a qualified technician;

(3) a chemist;

(4) a registered professional nurse;

(5) a licensed vocational nurse;

or

(6) a licensed or certified emergency medical technician-paramedic

or a licensed paramedic.

(B) A blood specimen must be taken in a sanitary place. The person

who takes a blood specimen under this chapter, or the facility where

a blood specimen is taken, is not liable for damages arising from the

request or order of the peace officer to take the blood specimen as

provided by this chapter if the blood specimen was taken according to

recognized medical procedures. This subsection does not relieve a

person from liability for negligence in the taking of a blood

specimen.

We have been thru this before, EMS does not need to be in the business of

doing this. There are multiple reasons including court time (OT), scrutiny

of your PCR (not necessarily a bad thing) and the potential for cases to get

tossed because of some technicality of procedure by the person drawing the

sample.

Just one of those legal loopholes. When buying a house, always put " pending

termite inspection " on the contract. Later, if you decide you want out of

the contract and they say " there are not any termites " all you have to say

is " I wanted termites " and thus you are out of the contract.
