Not here, because was dx'd so early, but I read of a couple in

NJ that won such a suit.

I've often wondered if anyone has thought to sue manufacturers of

Swings, carseats, bouncy seats, etc, for not making them with memory

foam now knowing that Plagio is such a huge problem often caused by

the above mentioned items......what do you say??/ Class action against

Fisher Price? Anyone, anyone???

This is not anything I really want to do. I just am so frustrated.

It took our ped almost 11 mo. to agree with me that needed

something. (even now she still thinks it could correct itself and

he's 16 mo. old) He has been in his first band for almost 4 months

and will be needing a second. My insurance approved our appeal for

the first band, but will not cover the second. Now I'm stuck, I don't

have an extra $3000 just laying around to pay for the second band. He

still has very noticeable flatness on the back right side. I know

with a second band we could still see some correction, but I also know

that we're not going to see as much as we would have if we had started

at a younger age. I had been bugging our ped. since he was 6-8 weeks

old and she never took me seriously. I'm just not sure where to turn

now. This is very aggravating.

Yes, there was a 2 million dollar verdict to the parents and child.

It was a case in Essex County. I will try to find the deatails if you

want me to, but I get a consulting fee if you win,lol.

LOL!! Actually I looked all the info. on the swings and carseats and

all, there is fine print that says, not to leave them for extended

time periods in most manufacturers brochures. Damn that would have

been nice,

Does anyone know what was considered "late referral"?

I would be very frustrated. It's funny, when my ped first diagnosed

I was insulted and thought she was being too dramatic at such

a young age. Now that I know better, I am so thankful that she is

so proactive. I am 100% sure that repo has REALLY helped a

lot and if we do go for the band (I am still a little undecided) it

will be a short term deal.

I figured I'd throw in my bit here... I have been in the process of

working with an attorney on this matter for oh.. almost a year now.

It's a VERY long process. Our case is a bit more extreme then most,

especially given that our son ended with surgery for his plagio.

However, we are still going forward with it. To be honest, the only

thing I care about is doctors taking responsibility for their

actions and what happened to our son because of it.

You see, our lawsuit will be to my ob as well as the peds -- my ob

caused my son's Brachial Plexus injury and, from what the nuero

said, his tort was almost definately caused from his vacuum

delivery -- which, as you know, often times causes the plagio. On

top of this, my son was diagnosed with the BP injury and tort within

12 hours of birth (all charted in his records) yet nobody bothered

to inform us. In fact, we didn't find out about his BP injury until

he was 6 months old.

I do feel the doctors are responsible for our now 200k worth of

medical charges -- thank goodness for insurance, but I still am

responsible for almost 12k.

So... wow, I babbled lol -- but, yup, we are speaking with an

attorney who has all of our information and we're just in limbo

here...
