Guest guest Posted August 12, 2002 Report Share Posted August 12, 2002 This is my first posting I`m ......My first daughter passed away only a day after she was born in 1991, then i`ve had 3 boys ages 10, 8, 6 and a 4 yr odl daughter......The day i had my daughter in July 1998 my then husband gave me a choice.....Tie my tubes or he was leaving, i chose to have them tied. Needless to say we seperated in 1999 and he told so many lies and had so many friends testify that i was an unfit mother all over 1 cup of spilled milk out back, said i wasn`t watching my children when in fact i came in for some water. He got the house, the cars and our children. I am now engaged to a wonderful man and talk of having a child has come up, only that neither of our insurances cover it. I have been on depression meds sin August of 2001 because i can`t afford to give him a child, he says he is fine with it....But i know deep down he wants one of his own. I cry at night from not being able to kiss my kids goodnight, say their prayers and tuck them in....I see them every other Fri-Sat, and every Wed from 4-8.....He is now trying to take overnights away saying that it`s traumatizing the kids being away from him and their own beds. But when they are here they don`t ask for him at all ad cry when they have to go home. He has even made it so that my fiance cannot take them to the store or park without me.......Said he abuses them and everything that he tried to pin on my fiance has failed but the judge won`t change the court orders. Has the judge ever ask your kids what was going on or where they want to live? You said that your oldest is 10. I know that in Texas at that age a judge will take into consideration what the children want. I think that I would ask the kids who they want to live with. I don't know anything else to do. I really think that the children should have a choice on where they want to live at any age. That is as long as neither parent is abusive. At that point, I think that the judge should take it into his/her hands. I think that it's terrible how people use child protective services now. The people that they need to be investigated never are. The ones who try to be good parents and bring their kid up right are always the first ones that they bother. I'm sorry. I know that this is extremely hard on you. I would die if I didn't have my kids. They literally drive me insain at times, but I love them. They are my life. I wouldn't trade them in for anything. I am going to school to be a paralegal so this is familiar to me. In the state of Ind the court will consider a childs wishes at the age of 14. You may want to check into what your states laws are concerning this. Your second option is to go to the court and ask for them to assign a child advocate. The advocate acts on the childs best interest only and will advise the court as to the best placement for the child or whatever the case may be. The only disadvantages to this are that it is time consuming while the advocate spends time with the child investigating and it can be a little more expenseive. I hope that this helps you.
