Guest guest Posted October 19, 2006 Report Share Posted October 19, 2006 Dear Forum, The fundamental rights of human beings to fulfilment of sexual need based on consensual behavior and the constitutional rights to livlihood are two basic issues that should inform any discussion on the questions raised by SANGRAM/VAMP. All our laws on morality are legacies of a pre-scientific era. They merely cater to one common way of life and undermine the rights of all minorities including MSMs and trans-sexuals. To attain clarity on these vexing issues coming up again and again, the right to consensual behaviour needs to be upheld by new laws as such. The objections of a third party should again be judged on the basis of denial of rights to the third party or a violation of a previous legal agreement entered into with the third party. The absolute vaccum of the concept of consensual behavior in our socio-political-legal arena leads to such classical mistakes as equating trafficking with prostitution and polarizing life-long commitment with circumstantial behavior.
