It is expected to be similar to the "paperwork reduction" provision that is already part of the House IDEA bill. The House bill allows 10 States to ask the U.S. Department of Education to set up Statewide programs to completely waive current paperwork requirements. House Democrats in the Committee report on H.R. 1350 say the bill "has absolutely no restrictions on what paperwork could be waived....A STATE COULD PROPOSE TO WAIVE IEPS or due process notices...." What do the House Republicans say? The program allow States "to reduce the IEP paperwork burden". The IEP is the only paperwork specifically mentioned. There is no question that the intent of Congress is IEP "paperwork reduction". This is totally separate from the new requirements for Standardized IEP forms for all States, and from the new requirement that "the bill makes clear that NOTHING beyond what is clearly laid out in statute [the final bill signed by the President] is required to be in an IEP", and from the new ability to do a 3-year IEP. If a State proposes to waive the IEP (since we will have once-a-year tests in reading and math under No Child Left Behind which is the new "accountability" to replace IEP accountability), and the Secretary of Education approves it, NO appeal of that decision is possible because IDEA 2004 specifically allows it all in the name of "paperwork reduction". If people really want to "align" IDEA with No Child Left Behind, they need to realize just what that will mean for many students with disabilities and their parents. IDEA and the IEP have required individualization. No Child Left Behind requires once-a-year standardized tests in reading and math.
