I've been stood up by them at meetings, etc. DON'T put too much faith in them. They're dragging their feet and you're daughter is losing. The school district is in clear violation of the law and you probably know enough about the law to take this on yourself. First of all, draft a complaint letter to the Bureau of spec ed for the dept of ed in your state. You have to give them a month or 2 to complete their investigation, so in the meantime you may want to go to due process anyway. Decide what you really want. I would never tolerate my child being sent 40 miles away, but if the school is really fabulous, and you think it's worth it, go for it. If they're just getting her out of the way, I'd fight for her rights in her home school. Also, a family sued American Airlines for millions of $$$ last year for a flight attendant telling them they couldn't feed their tube fed daughter with CP during flight because the passengers were complaining it's " gross " . The family wons (MILLIONS of $$$). Contact the ACLU in your area who takes cases for free. They may not feel they have enough knowledge of spec ed to take the case for you but it's worth a try. Isn't it a shame, kids are so much more understanding and compassionate than adults. Maybe at your hearing, some of these kids who sit with her at football games can testify on your behalf that it's not gross, etc. though that really shouldn't be an issue anyway.
