Regarding any parent who feels their child was affected by an adverse reaction to a vaccine (MMR, DPT, hepatitis B, polio, etc..or combination thereof), please call Tel 800 822-7967 for VAERS and get their form to fill out for an adverse reaction. Make sure that you mention autism in the form besides any other reactions you have seen as for example rashes, fever, seizures, etc. If filing in a lawsuit for a vaccine reaction, contact the NVICP at 800 338-2382 for the information needed to file. We are interested in pursuing a claim for damages to our now 8 year old daughter from the cumulative effect of mercury toxicity which was a preservative in her vaccinations. We believe that her autism was a direct result of these vaccinations which began at 9 days of age, and continued to about the age of 2. We understand that a 3 year time limit exists, but are interested in an alternate suit, due to cumulative effects, and based upon the time when we became aware of the mercury content in the vaccinations. We have the VAERS form, but have not yet filed it. Does your firm have any similar cases at this time, and/or are you interested in pursuing this? Guest guest Posted February 5, 2001 Report Share Posted February 5, 2001 Joe & Theresa, No personal experience with mercury lawsuit, but know of a Gage who played a role in a class action law suit against the makers of " bad lots " (isn't it al!) of DPT. Never heard how the suit turned out or whether its still in law suit limbo somewhere. Last I knew one could contact him in Cheyenne, WY at phone 307-632-1112. I believe when I spoke to him a couple years ago it was too late to get my nephew in on that class action suit. Guest guest Posted February 7, 2001 Report Share Posted February 7, 2001 I called both these lawyers groups and they stated that they are no longer filing these suits because they are too hard to prove when a person gets a multiple vaccine in one visit and that they are getting thrown out of court. I received this response from one. <<Joe and Therese, Thank you for the email. We are not handling civil suits. We have all we can handle just to handle the claims. You need to look at our web site and then lobby your Representative and Senator about changing the law. The bills referred to on our web site would have the effect of allowing you to bring a claim. Cliff Shoemaker www.attorneyaccess.net>> If you enter their website, the second new item "two bills,..." will give you information on HR5327 and HR5330, Two bills introduced to the house that will allow people such as ourselves to file a claim. I wrote a letter to my congress-person & I would recommend that everyone take this action. I am still not sure whether to file the VAERS form at this time, but it appears that these two bills will open lots of doors! If you go to the safeminds website, there is easy access to write to your representatives. Please take the time and do it. Also if anyone has the NY Times for Feb. 7, 2001 - look in section B for an article "Bill seeks to ban the use of Mercury in a variety of common products" If this ever passes, I would have to say that there may be some hope in the political process.
