I think there is more to this than meets the eye.

The way I understand it, there is no law that specifically addresses

herd shares in NY and so far the arrangement has not been legally

tested - it's grey.

Of course if you ask the state for permission to do it, they will

likely tell you no, in spite of the fact that they may not have that

authority.

You can not legally sell herd shares in NYS- you must hold a NYS raw

milk permit to do herd shares or sell raw milk.

I know of a couple farms right now in the transition over to permit from shares- with the state.

One farm had been doing shares for a few years. I would be interested in hearing of others doing shares.

My inspector is helping a few farms transition right now to permit.

I also know of a local farm fighting the issue in court- not sure hwo that is going, long prosess.

I agree we should be able to buy and eat drink as we would like -Liz
