AUGUSTA, Ga. — A former employee of the Medical College of Georgia filed a

wrongful termination lawsuit on Oct. 3, alleging he was fired for complaining

of mold and mildew in the college’s hospital facilities. Brandenburg v. Board

of Regents of the University System of Georgia, et al., No. CV106-152 (S.D.

Ga.).

T. Brandenburg asserted claims in the U.S. District Court for the

Southern District of Georgia under Georgia’s whistleblower statute (O.C.G.A.

§

45-1-4) and the U.S. Constitution’s Free Speech and Due Process clauses.

Defendants include the Board of Regents of the University System of Georgia,

which operates the Medical College, MCG Health Inc., the college’s hospital

arm,

and college and hospital officials identified as ' and Jane Does.'

Brandenburg said he complained of mold and mildew in hospital facilities in

the spring and summer of 2005 and that he was 'written up' on July 29, 2005,

for voicing the complaints.

Brandenburg also raised allegations of unfair treatment unrelated to the

mold issues.

He alleged that college and hospital officials cancelled contracts for

Brandenburg’s bottled water business, after years of operation, in favor of

another vendor who, Brandenburg charged, was a member of the hospital’s Board

of

Directors.

Brandenburg also complained he was called into work while taking time off

for a work-related injury, and just prior to his firing was reprimanded for

conversing with the family of a patient who had complained of the patient’s

care.

He said he was terminated on Oct. 3, 2005, without notice or a hearing.

Brandenburg asked to be reinstated and awarded compensatory and punitive

damages.
