As for being legal there is a lot of not legal things that go on all the time. Just because it is not legal does not mean someone won't do it. Yes, you do need a preservative in anything that contains water in any amount. There are lots of different preservatives so you need to do a little research on which work best in your application. www.lotioncrafter.com has information on a lot of them. The FDA does not require that any ingredient that is less than one percent of the product be listed, so perhaps that is the answer -- their preservative is less than one percent. Very possible.
