Monday, August 20, 2001 12:00pm By Alan Muller Email article Print article Delp of the Wilmington area is pursuing a pioneer mold case in Delaware. After experiencing severe illness she believes is connected to molds in two rental housing units, she approached many doctors, health officials, politicians and lawyers without getting the help she needed. Note: This case was eventually dismissed, essentially because Ms. Delp was unable to obtain effective local counsel. Awareness is growing of the health hazards posed by molds in buildings. Many molds are very toxic and cause sever illness. More and more litigation is happening and some observers are predicting that " mold " with be the " asbestos of the future. " Delp of the Wilmington area is pursuing a pioneer mold case in Delaware. After experiencing severe illness she believes is connected to molds in two rental housing units, she approached many doctors, health officials, politicians and lawyers without getting the help she needed. Finally, she filed a lawsuit against former landlords in the Superior Court of Delaware. ( Kay Delp v. D. Reilly (Przywara) and Steve Reilly, Arbor Pointe Associates, Stoltz Management of Delaware, Inc., Civil Action No. 00C-06-211 RRC) Delp has had great difficulty in finding local lawyers to help her, and has had to pursue her case " pro se " --representing herself. This would be tough under any circumstances, but the physical and cognitive problems caused by her illnesses have prevented her from meeting the schedule set by the court. A hearing is scheduled for Tuesday, August 21st, in the Superior Court in Wilmington, Delaware, at 8:30 AM. Lawyers for the property owners Delp is suing are trying to get the case dismissed. Delp will be asking for additional time to find a lawyer. Courts often claim to be supportive of pro-se litigants, but cynical observers see it otherwise. In Delaware, where authorities boast of the role of the courts in serving business and promoting " economic development, " this case is worth watching. Will Delp have her day in court, or will her case, to which she has devoted hundreds of hours, be thrown out? Wait and see....... Alan Muller Executive Director 6/21/06 When Will They Listen(About the health dangers of mold) I will try to be brief. I have been trying to save lives ever since I became very ill from toxic mold that was growing in the walls of a home I was living in about nine years ago. Last week I received some encouraging information for all the sick people all over the country that have been dealing with this horrible illness, and the general public is not fully aware that there are so many that are suffering with this illness. My previous post regarding " Significant Judgement Impacts Mold Victims " is very important to the victims, and I wanted to write a little more about it. The recent judgment in California that " discredits the entire foundation of all the medical associations, government documents, etc " , that illness from mold indoors is improbable has been long overdue. Apparently several men that write for these journals have also been getting paid as defense witnesses and getting large sums of money--and at the same time writing for these government agencies that inhaling indoor mold does not cause serious illness. I was perfectly healthy before this illness destroyed my life. Many that are ill have known this information for quite some time and have desperately tried to educate doctors, the press, or even our relatives. We of course have written to our congress, legislators for so long, there has been legislation that has been dragging for several years that Congressman Conyers, Mich. introduced HB1269-- previously HB1268. We tried to warn congress on the internet to document our efforts right after Hurricane Katrina that New Orleans would be having a serious mold problem very soon, and of course that has happened and people are suffering because they did not receive the proper information. I myself have written or called Senator Biden, Senator Carper, Governor Minner, Congressman Castle many times regarding hearings in Washington regarding mold or pleaded for help to no avail. Senator Kennedy did arrange hearings in Washington sometime last winter, and I am not sure if any of our representatives attended. We are not given information as to who attends these hearings, but nothing has been done to help anyone. So much suffering you can't imagine. Housewives and teachers are a large population that are getting this illness since many of our schools are moldy. Recently Massachusetts has had serious flooding and now Houston is dealing with flooding as I write this to you. I am presently homeless because this illness has had devastating affects on my family's health and finances. This is what happens to most people with this illness. Many of us get so ill that we cannot be around everyday cosmetics because of all the synthetic chemicals that cause serious asthma, reactive airways disease, organ damage, etc. Rep. Henry Waxman, Calif., has written information regarding the dangerous chemicals in our cosmetics and also written about letters from Washington writing to other countries warning not to regulate our products--even though the EU government is starting to regulate their products. Even some provinces in Canada are considering getting serious regarding our cosmetics, fragrances and limit use in government offices and possibly bars, etc. About 70% of asthma is irritant induced and it is becoming an epidemic among our children and population. The inhalers do nothing for me. Avoidance is the only thing that helps. I can even go out on a humid day like this week and feel better than around fragrance or mold. Of course in the city or near a grill it is different, but in general I feel better outside than indoors near these chemicals. So it is possible to feel better if not for these problems. My family has moved several times since I became ill, and I have become so sensitive to chemicals and mold that it is difficult to find a place where I am not vomiting or living with serious pain because of mold or chemicals. Each one of the homes have been very nice but had some kind of unknown leak. The last place was a brand new apartment but they put the exhaust system by all the windows, so it is basically like having the dryer exhaust coming into your window. I can't imagine a baby sleeping by the window and getting all of the dryer exhaust, and most mothers don't know this information. I of course tried to call my legislator and ask why in new construction they don't consider putting the exhaust systems away from the windows--because it is very dangerous for everyone, babies, the elderly or anyone that has asthma--which seems to be a large part of our population. No one returned my call. I would be happy to send any documents, etc., to back up this information as I am trying to be as brief as possible. I have been staying with several relatives and all have very beautiful homes but unfortunately just about everyone has some type of mold because of either a small roof leak, gutter problem, fish tanks or ponds that should be maintained properly. Every one of these relatives has either asthma, migraines, heart problems and unfortunately most people just take a pill and are conditioned to think that mold is not serious and does not cause these health problems. I have tried to educate most of my family, but you can only say so much especially when you are in such serious need of help. My husband had seizures in one of the homes we lived in several years ago. If only people would know how serious this problem is for your health, so many could avoid such illness. I don't care if you are Republican or Democrat; I have voted for both- -someone needs to do something. I have sat and watched these elections and so much money being donated to these people, and it is so sad that all this money is wasted on elections and there are so many in need in this country and the world for that matter. The Democrats say they can't do anything until the Republicans are out of office and the Republicans do nothing either. Bush had mold in the governor's mansion in Texas in the 90's, and so did the Governor of Louisiana right before Hurricane Katrina. You would think they would have done something. Those people were helped but we are left to suffer needlessly. Some people with this illness tried to warn the firefighters, etc. after 9/11 to wear proper masks when going through all that debris, and now so many are dying at such a young age. It is so hard to sit back and watch this suffering and be so helpless. Thank you for you time. Delp, Delaware Comment: After receiving mold complaints from another person whose daughter was affected in a public school, we checked with the Division of Public Heath and were told that that fall, fifty percent of the schools checked were found to have mold. Guest guest
Very Interesting, but a little confusing, because on May 7, 2001, the Delaware Supreme Court upheld a 1.4 million ruling in the Stroat vs. New Haverford case. Guest guest
Yes I remember the Stroat case. I tried to get the same lawyer but since I had to wait for 8 months for an appointment for Dr. Johanning and then he resigned several weeks after my visit everything dragged on and I had to work on the case for so long by myself, and eventually that lawyer couldn't take my case because by that time she was vey booked, and sometimes they are afraid to take a case that someone worked on for so long. I had a NY lawyer ready to take the case, but the judge didnt' give us enough time to get that local lawyer. Delaware is a very corporate state and I was sueing a very large corporation. One lawyer that helped me from Delaware in the beginning to file the case waited til the last day of limitations and told me he was friends of the people I was sueing. Such ethics. > > > Check this out, I had a case in 2001 dismissed. > > Today this was > > reposted at a site for the Green Party that was > > written back in > > 2001.
