First of all, let me say how terrible I feel that they are treating you this

way. I salute your courage to fight for your child. It pains me greatly

that you must fight to have your child's basic rights met.

Second, STOP CALLING. If you want to get the school's attention, you must

put your requests in writing! STOP CALLING. Also, I would start cc your

state legislators every letter you write. Congressman Pete Sessions says

that he attends ARDs for constituents. See if you can get a local

politician to attend with you.

Third go to http://www.tea.state.tx.us/special.ed/medcom/ and review the

complaints process. DO NOT CALL THE PARENT LINE. NO ONE ANSWERS IT. Make

your complaint in writing. Based on what you said in the post, you have a

complaint on two points, possibly three. You must spell all of these out

separately in the letter. 1) school dismissed your child early 2) school

sent home no registration papers 3) school denying services that were

approved/requested by the ARD committee. You must complain in writing about

these three things and request that TEA review the attendance records (to

see if they have been falsified) and see if it is the policy of the school

to deny services that were required by the ARD committee. I would cc a copy

of your complaint letter to both your state representative and senator.

You may also have a case to file a civil rights suit. I AM NOT A LAWYER.

This is not legal advice. I would suggest that you contact Advocacy Inc. or

a lawyer in your area to see if you have the grounds (much less the energy

and money) to file a suit.

I would also encourage you to submit your experience to TEA under their

sunset review, that they do not have enough personnel to respond in a timely

manner. There are only 4 people to investigate complaints for the entire

state of Texas.

However I recd a phone call from the front office stating that he was

not going to be able to attend summer school because registration had

ended. I never recd any reg information, nor was I told about it. It

was not included with his things that came home when school ended.

One of his former teachers (who's very fond of him) came by to check

on him and when I told her about the phone call she was outraged. She

said the Spec Ed teachers were conspiring to not have any of the kids

return so they wouldn't have to be bothered with them. The teacher

stated that " he wasn't learning anything anyway " and asked why did

she even contact us and that she needed to " put up with him. " Now

this same teacher that made these comments is the principal's niece!

Futhermore, after graduation, they told me not to bring him back,

making it seem as if it was a special privilege to the 8th graders.

Come to find out that was all part of their plan. So that means that

someone fudged the attendance records as well because they had at

least two more weeks left in school and I was later informed that all

of the reg ed 8th graders were still at school. I have made numerous

attempts to contact the principal, but I can only leave a message and

I believe it is with the same person that told me he could not come

to summer school so she is not giving her my messages and I can never

catch her at school. What good anyway with the culprit being her dear

niece. I called the director of special ed for the NE district &

they're out on vacation. I also called TEA and they gave me another

person to call. Now this has been since June 7th and I'm still

waiting. what can I do??? Please somebody help me. I am so hurt &

angered that a teacher would do this or say such mean things about a

child.

Contact Peyton at the TEA SpEd Complaints Division. His direct

line is (512) 463-9414 and if he is on another line, an assistant or

secretary will take your name and I have always know him to call back.

Even better tell him that Amy Sosa told you to call. We have a very

good relationship and he is awesome. Have a notepad ready because he is

very smart and will be giving you much info at a fast pace. And before

you get a lawyer, do contact the Office of Civil Rights. It will save

you the money. And I don't know for certain if this is one of the

Advocacy, Inc. agenda items. But it is worth a try. Good luck on

getting help from them (sarcasm). If you need an advocate to go to

school or help more, you can email me and I'll see what I can do. I am

a volunteer advocate with the Federation of Families and it might just

take a letter and a follow-up phone call. But you are likely due for

compensatory services that TEA can help you with. And follow what

has said. She has given you all the right answers to your

problem. Feel free to call me.

DEAR KEISHA,

I FEELYOUR OUTRAGE. I HAD A SIMULAR EXPERIENCE WITH MY

SON. HE IS 4 WITH SUSPECTED AUTISM AND DOESN'T TALK. AT NAPTIME THE

AIDES PLACED HIM IN A HALLWAY ALONE AND ALTHOUGH THEY SAID THEY WERE

WATCHING HIM HE MANAGED TO OPEN THE BACK DOOR LEADING OUTSIDE THE SCHOOL

GROUNDS( NOT 10 FEET AWAY FROM A STREET WHERE A CHILD HAD RECENTLEY BEEN

STRUCK BY A CAR AND KILLED). THEY NEVER EVEN MISSED HIM. ANOTHER

TEACHER FROM A DIFFERENT AREA OF THE CAMPUS SAW HIM AND TOOK HIM TO THE

OFFICE. I CONTACTED 3 DIFFERENT LAWYERS AND SENT LETTERS TO ANYONE AND

EVERYONE I THOUGHT MIGHT BE ABLE TO HELP. NO ONE WOULD HELP ME OR TELL

ME HOW TO GET HELP. I WAS TOLD IT WAS ILLEGAL TO SUE A SCHOOL AND IF I

DID MANAGE TO MAKE A CASE THE SCHOOL WOULD WIN DUE TO GOVERNMENT RULINGS.

I HATE TO TELL YOU THIS, BUT EVEN IF YOU DO GET A HOLD OF SOMEONE ABOUT

YOUR SON, DON'T EXPECT TO GET VERY FAR. I HOPE YOUR EXPERIENCE IS BETTER

THAN MINE. I WISH YOU THE BEST OF LUCK. I'VE LEARNED THAT YOU HAVE TO

TAKE A STAND AND FIGHT FOR YOUR KIDS BECAUSE NO ONE ELSE WILL.

Dear Keisha,

Regarding the previous suggestions on the EYS discrimination.

Going through TEA-------- TEA will kick the written complaint right back you if

you haven't gone through the appeal channels in your district.

You've tried the sp ed director, but found that person on vacation. The next

thing I would do is go to the superintendent's office. If the supt declines to

take corrective action immediately, then you must go to the school board as part

of the appeals process. You must do all of this before TEA will entertain your

complaint. I know this to be the case; I worked for TEA for a time.

However, this is a lot of dilly-dallying, and I suppose you still want your

child in the extended year program. which is already in session. I would

contact Advocacy, Inc. *** right now *** to get their advice, even before I

meet with the superintendent.

I actually don't think that dealing with TEA will get the quickest action. They

may respond to your complaint by investigating, but it will take a long time to

get them rolling, and by the time they do anything, the summer session will be

over. In the mean time, your child will be missing the education that his IEP

calls for.

This is gross misconduct on the part of the school district. Falsifying

attendance records can be grounds for losing Texas teaching and administrator

certificates. As a lifelong educator, both teacher and administrator, I think I

have heard it all in regard to the school district trying to get out of

implementing the IEP, but this one just about takes the cake. I agree that a

civil rights investigation should take place.

Having said all that, I do think you should ultimately lodge a TEA complaint,

after giving the school district the opportunity to fix this. This outrage

should be called to their attention, even if ultimately they don't really help

you.

Schools really aren't afraid of TEA. But they are afraid of the Office of Civil

Rights and Advocacy, Inc. I used to conduct school compliance visits for TEA

(the dreaded DEC visits), and we were required to hold open meetings in the

district so that parents could air their complaints to us. I always felt sorry

for the parents who thought that contacting TEA would scare the district into

correcting things. It just doesn't work that way.

Bless you. I am so sorry that this is happening. (But, alas, I am not

surprised.)
