I am the mom of a 12 year old boy with several diagnosis, Autism/aspergers, tourettes, OCD, bipolar and adhd. We live in Ontario. My husband died 7 years ago so it is just me raising my son. All those labels do nothing to help the situation we are facing now and that has caused me to ask your advice and comments. My son has very agressive tendancies when he is anxious or his sensory system is overloaded. Today at school it was track and field day and of course the change in routine and the rainy weather upset my son more than a usual day at school. He got overwhelmed and ran from the group to a nearby playground. He has an EA who followed him but her presence seemed to escalate his anxiety until he reacted by kicking and hitting her. At some point the police were called and the Ea is pressing assault charges. Because of his age of 12, the charges will mean a court appearance etc. Does anyone have any advice? Any ideas? Ever heard stories like this and what the outcome was? I am so concerned and upset that this is happening. I would appreciate your responses. Guest guest Posted May 27, 2006 Report Share Posted May 27, 2006 thanks for the reply...this is the second year the EA has worked with my son...she usually can manage situations but yesterday got out of hand and she's had enough...What do I do now? police charges are serious and the constable advised me that his last case like this the youth was put in a mental institution...it like my worst fears are happening. What are the rights of autistic people regarding outbursts such as this, the police said regardless of your ability/disability "assault" is treated the same from a legal standpoint...is this true?? Guest guest Posted May 27, 2006 Report Share Posted May 27, 2006 Hello there Corrotstix, Just want to greet you to this group, and share with you that we have all dealt with this type of thing. I feel so sorry for your son, and for you right now, because I don't see why the aid could not understand how upset he was. Like you said, the change in routine and track day and rainy weather all contributed to his inability to adjust and to cope. I do not understand why charges would be made against him with these issue at hand, and hopefully they will be dismissed because of them, and he gets a new aide! My son is 41 years old now, but when he was in school he had a great deal of trouble with the people, programs, etc. He would get very upset and what they called "noncompliant," and they struggled to try to manage him. It was a mess. It fist started when he was at a special ed school, and then right in the middle of it all they mainstreamed him into public schools, first junior high, then high school for awhile. I tried to tell him he would not be able to handle the large crowds of other kids, banging lockers, noise, etc., it would be too much stimulation for him, and I was right and he just got worse and worse, when he was really upset he would scream and bite his upper arm, as he could not say many words. And he had a lot of seizures brought on by his anger and frustration I think. At home he acted out even worse, and threw things, and attacked me quite a bit. I think at the time he was just frustrated with me because I did not understand what he was going through at school, and refused to help him. Well finally I took him out, he was 18 then, and life has been pretty peaceful since then, at home with me. Just wanted to say nobody ever called the police on him, I mean it was accepted knowledge that he had a problem in his brain, they didn't call it autism then, but this is what it was none the less...... She should have been trained to deal with situations and ways to calm him, and they should have been prepared for all the changes!!!!! These are things that are hard for the child to control, and it sounds like she further aggravated it!!! My son, 7, is aggressive win overloaded too, and we have had many problems in public school with non understanding! You need an advocate at this point! Don’t give up…It sounds like there is not good understanding with your child’s disability! Guest guest Posted June 10, 2006 Report Share Posted June 10, 2006 To my knowledge, if your child has an IEP in place he should be somewhat protected and even more protected if he has a functional behavioral assesment along with a behavioral intervention plan in place. How old is your son? Where do you live? Do you have a copy of your parental rights? Have you contacted an attorney that specializes in such special ed cases?
