I would say no unless he poses some type of danger to the public but even then with the American with Disabilities act there should be some type of protection. What's happening?

This has been posted on several autism lists and now the talk of them all. If the autism community is so divided on this issue I can just imagine the court room scenes.

Anyway from the last link posted on groups today I read it a bit more fully and it said that there was a PET - not IEP - but some sort of agreement and then once the school personnel noticed inappropriate behavior they required a behavior assessment and for some reason not stated the family would not so it seems they no longer have access to the playground since they did not comply with request.

Then the court document says something about the plaintiffs not exhausting the proper avenues since they mentioned IDEA so one month later they dropped the IDEA reference and are now seeking damages.

The link posted yesterday to some court document showed Septmber of 2004 - and now todays mentions May 2000? Where are these documents coming from?

Honestly I have two kids on the spectrum and a full plate and not really interested in debating on all the lists about this .

We are not being told the full story and now a request to help them out financially with a special web page?

Sorry does not sit well with me, why did they refuse to have the behavior assessment? I know of many families who post on groups that go through hoops to get such a thing from their schools, so not wanting to comply with the request and no explanation says there is more to the story than what has been shared, a page that has discrepancies in dates.

I used to live in Maine. A PET team is the same as an

IEP team, they just still call it that (pupil evaluation team).

from the courts. I'm sorry to have originally posted the OLD link, they

were JUST in court again and the new court link is the LATEST decision.

It was never my intention to start a debate, only to make folks aware

No - NO ONE is asking you to " help them out financially " and *I* am the one

who has put up the web page and will be paying for it though none of this

will affect me *legally* as I am a Canadian as are my 2 autistic kids. *IF

YOU WANT TO HELP* and ONLY if, this is the request on that page:

" People who wish to help, can contact these organizations and request their

assistance in the form of amicus curaie. " All you are being asked to do -

IF you wish to help - is CONTACT organizations and " request their

assistance in the form of amicus curaie. "

NO ONE IS ASKING YOU FOR ANY FINANCIAL ASSISTANCE!!!

Please - Gayle's contact info is there - ASK, if you feel like you aren't

getting the full story ASK!

Given what all she is going through, if she can't perfectly satisfy you in

the information she has given me to post then PLEASE - contact her and ask

her - don't publicly write her off when you have the information at your

fingertips. (And please don't spread mis-information like that she wants

money, or any ASSUMPTIONS you may be making about the situation)

I dont know if there was suppose to be a link on this, But HECK NO no child with Autism should be discrimated OR BANNED.... Thems fightin words for this Granny !
