How about with the gardener leaving the vehicle running while he was off of it it was a safety hazard to kids besides being possible for anyone to take it? (if there was a mower attached and it was also running, the danger is multiplied. Including an adult theif of a malicious child? What about their responsibility for his safety, knowing this is a child with impulse control? Why wasn't anyone with him? What was the gardener doing that he didn't notice someone getting on and driving it? Have they ever done a functional behavioral assessment? They can't just remove him unless they have done everything they can. They have to do an FBA and they have to have tried a behavior plan for a period of time(at least a couple months anyway-I would say a bare minimum of three months, I don't know the legal amount of time for attempting to make one work) I don't think they can easily or legally do this. They should certainly have far more leniency with a child that age...I didn't realize how old he was, I was thinking he was older for some reason. He sounds like quite a character indeed:) My son is too, really funny and quirky and has his own perspective on things, that's for sure. Any kid 6 years old would be tempted to drive the thing left running...I think they need to make the gardener take his keys with him:).
