Guest guest
Dear colleagues, Here are the Workers' Comp Division's notes and some documents relative to the Administrative Rules Advisory meeting which took place Monday of this week. Click on the Word document and go to the following issues and pages: Issue 009-002 OAR 436-009-0040(4) Screen 13 or 26 This is the discussion relative to the conversion factor and increasing it as per our E & M Codes. As you al recall a couple years back this was adjusted down. Then go to: Issue 015-002 OAR 436-015-0030(3)(f) Screen 22 & 23 of 26 Expanding the MCO panels issue. Though the note taker didn't indicate so please understand I gave our colleagues in ODOC full credit for the Freeman survey which was commissioned and paid for by ODOC and that which was spearheaded by Dr. Schmidt. I also mentioned the CAO survey which the Freeman survey validated finding the same problems with the system. Also note that Fred Bruyns " Rules Coordinator Policy Section " has also included an attachment which has the Freeman survey. So now what? Well we wait and see what proposed changes if any DCBS comes up with and if any substantive changes occur with the MCO panels if should get lively at the proposed rules hearings! Keep your fingers crossed that this will not have been wasted time and energy.... Vern Saboe Advisory meeting notes for 2-11-08 plus additional advice Rulemaking advisory committee Thank you again for giving us your time and expert advice on Monday. We rely on the information you provide when we write the proposed rules. I should have closed the meeting by explaining that we plan to file proposed rule changes with the Secretary of State by the 14th of March. Unless something causes us to delay that filing, I will distribute proposed rules to the committee by March 20. I will also let you know if there is a delay. I have attached: 1) " Advisory Meeting Notes 2-11-08 " (Please contact me if you notice errors or omissions.) 2) " Advice from V Saboe DC Freeman Survey " (available at the meeting; not sent electronically) 3) " Advice from Arden Olson AAL " (available at the meeting; not sent electronically) 4) " Advice from Liberty Ins Pharmacy " (Submitted after the meeting, in response to WCD's request for additional advice.) 5) " Advice from SAIF compiled " This includes: a) List of concepts related to OAR 436-009 & 010. Shaded items propose adoption of reasonable fee schedules where none currently exist. (available at the meeting; not sent electronically) Proposed changes to 436-009-0070(8) Interpreter rules (available at the meeting; not sent electronically) c) Draft proposed changes to OAR 436-009 (SAIF asked that this be shared with the committee.) d) Draft proposed changes to OAR 436-010 (SAIF asked that this be shared with the committee.) After our meeting, we noted that the bold appeal language in OAR 436-015-0110(5) and (6) refer to the " Medical Review Unit. " The Medical Review Unit has been absorbed into a newly created Medical Section. Because we would like to update the toll-free number information in these paragraphs anyway (no longer just toll-free from within Oregon), we thought we should make this additional housekeeping change. Please let us know if you have any concerns. Some internet service providers may not allow this many attachments through their filters. If you do not receive five attachments, please contact me and I will find a way to deliver them. If you have questions or I may assist in any way, please contact me at the phone number or e-mail address below. Thank you again! Sincerely, Fred Bruyns, Policy Analyst/Rules Coordinator Oregon Workers' Compensation Division Policy & Communications Section (503) 947-7717 fax (503) 947-7581 fred.h.bruyns@...
