Hi Gail I live in Australia and here you can get an enduring power of attorney I think that is what it is called my sister went to a solicitor and as she split up with her husband had it changed so that my mum can make decisions for her if she is unable to she also has her listed as her next of kin at the hospital so any medical decisions they run by mum first. When I was first ill and I had needed a procedure they got my husbands permission. I would ask your solicitor or attorney about it. Hope that helps in some way

I have never heard of this and I am out of my mind with this right now. Any answers?

Gail, this sounds like the HIPAA regulations, a federal law that limits health care providers and institutions from disclosing an individual's health condition without the consent of the patient. If you are indeed the "official" caregiver, I believe you can obtain legal paperwork authorizing you to get information and even make decisions for the patient. The legal paperwork needed varies by state. I've never heard of a spouse being barred from the ER except where they may get in the way during medical procedures.

I think Mike is right.... Perhaps though is all you need is to have your young lady friend insist you stay with her... I know how you feel, my son is 20 and they don't want me around, but the ER doc was nice to let me stay....

My wife has been with me a number of times and there was no problem I think the hospital is wrong about this. I also work for a health ins company and Hipaa (cant spell) and I believe spouses can get the info with no problem. As far as the person you are caregiver for, My wife has power of attorny and finacial power for my inlaws. You can get a type of power for the medical stuff to. Talk to a attorny should not be very expensive at all 200 dollar or so.
