NVICP--Omnibus Autism Proceeding

Lyndia:

I am one of the attorneys on the Petitioner's Steering Committee that

was formed well over a year ago. I am familiar with all the details

surrounding the Autism Omnibus Case since I have been working on it ,or

preparing for it, for the past 3-4 years, I have a ton of detailed info on

my website about the Omnibus Case and the VICP generally-- www.jzslaw.com

I am shocked that an attorney advised you " to not file at NVICP. " The

VICP is not optional, it mandatory! My goodness, an attorney has an ethical

obligation to TELL YOU ABOUT THE VICP!!!!! (see below--Sec. 300aa-10 (B))

The act itself says:

" Sec. 300aa-10. Establishment of program

(a) Program established.

(B) Attorney's obligation It shall be the ethical obligation of any

attorney who is consulted by an individual with respect to a vaccine-related

injury or death to advise such individual that compensation may be

available under the program for such injury or death.

© Publicity The Secretary shall undertake reasonable efforts to inform

the public of the availability of the Program.

Was your child diagnosed after February 2001 or before?

Dear Jeff,

Thanks for the information. I should have clarified that when we first

filed a claim for our son, our attorney was filing in the civil courts.

(That is why no NIVCP or medical records released to VAERS) Of course

the gov. made this impossible and my son is out of the three year

statutes of limitation. He is eight years old now. I think a lot of

the 90's kids will not be able to be heard.

There was some hope with the possible passage of HR 1349, but it looks

like special interest groups (gov., CDC, FDA and pHARMA) want to keep

this can of worms sealed up.

It is a great injustice to our kids, and I found out that because of

this, the law firm we were working with closed 90% of their thimerosal

cases!!

I just try to stay abreast of what is going on for the ASD kids. Yes,

life long care is an issue, but what upsets me more is the injustice

done to our children and the criminals that are getting away with it.

Hi Lynda:

Good point--my twins are 9 so we are waiting on HR 1349 as well. We are

working very hard to gather co-sponsors for this bill on behalf of Chairman

Burton. Please be sure to contact your Congressman to see if theu have

co-sponsored it. If not, ask them to become a co-sponsor. Form letters are

available on my firm's website.
