I received child support until my son was out of high school by a court

order.Isnt ashame,we have a right

by law,yes in Illinois,to receive child support forever but when we do get child

support it ssi  keeps us from getting it.Something is wrong when there are laws

to keep us from giving our children what they should be allowed to have just

like another adult .This same law does provide for college education to be paid

for by the

parent  I am not sure what impact it has on ssi but I am sure they will find

away to make sure it does..

also,if your child has an state id card  remember to put emergency contact

information on

its available for everyone to have on driver license,id cards

I was just wondering how many of you continued to receive child support (going

into a payback trust) while getting SS? Just wondering how common it was, and

whether I want to approach the subject with my ex as I think he will fight it.

The divorce decree states that support shall not stop at 18 because of her

special needs, rather support shall be determined based upon her ability to

survive independently. I have not yet applied for SS or had the trust drawn up

yet, she will be 19 this June. I'll appreciate your input, thanks

Ellen previously updated my article on the impact of Child Support on SSI, as

well as the " solution " . I also have a more in depth " resource " package for

divorce lawyers on what must be done in the court order so as to NOT impact

negatively the SSI. The SSI rule changed on this by " policy " in 2008 and in

writing in January 2009 in the POMS. Ellen, if need be I can forward to you the

documents again to upload top the site.

Situation analogous to my complaint a few years ago about 529 plans and

someone's comment that legislation couldn't be crafted to allow 529 money to be

redirected when disability requires other post-secondary training. (Although

didn't I just read something this being proposed anyway).

Yes, on behalf of the Arc of Illinois, I helped draft the legislation and it

passed out of the house Committee and if passed by the house (hopefully soon)

then on to the Senate. However, this is State legislation and NOT Federal, so

the tax benefits are limited to Illinois income tax. There is also pending a

Federal Bill called " ABLE " but it has been pending every year for years, is

again being revised, and is still in Committee. The Arc of US doesn't give it

much hope of passing this year.
