I assume Logos/trademarks have to be protected. Gayla, got that info. as I am thinking of tee shirts bu want to protect my ideas...Any suggestions would be apprecaited. I can't help much with copywriting logos, but I wuld send myself a Registered letter with my logos in it. Don't open it. Just write what is inside for reference. It will set the date of your designs.

Anything done at Cafe Press won't be protected either.

As far as I know, you can make and buy one item or multiples. I've

never known of a minimum order rule unless they've changed something

just lately. You start on their " Create " page of the site, pick out

what you want to make (from a T-shirt to a messenger bag to a coffee

cup), upload the image you want to use, tweak the design using

different buttons on the site like " Preview " and " Make Changes " , when

you're satisfied you click finish, save the project and then order.

You can also set up a Cafe Press store and fill it with your designs

on their products, direct people to your " store " and when they buy

and order you make a certain percentage of the sales. I haven't read

all of that fine print in a few years but a gal that used to work for

me set up her own Cafe Press store and sold merchandise with her

cartoon designs; I know a guy now that lives in New York and he is

in the process of opening a scooter shop. He's spent a few weekends

designing funny things about scooters, loaded a bunch of stuff with

his designs in a Cafe Press store (I do believe the store is free)

and he is already selling T-shirts. He's got a design that says

" Does this scooter make my butt look big? " and it is evidently

selling like hotcakes due to email he sent with his store link to

scooter groups he joined. One word of warning: teh scooter

guy created a design based on the " Got Milk " commercials and it said

something on the order of " Got a Scooter " or something like that -

anyway, the Milk Board contacted him and told him to take the design

down because they felt it infringed on their " Got Milk " slogan.

Regarding your designs, anything you write in your own words or draw

is automatically copyrighted upon creation. However, just because

you use a copyright symbol on your work doesn't stop someone from

using or copying your designs. I don't know if a court case would be

worth the expense or hassle if you caught someone using your design,

but you can do what is called a " Poor Man's Copyright " which only

costs pennies instead of the thousands buying a trademark would

cost. Put your original work in an envelope, seal it and mail it to

yourself (it is preferable to mail to a third party, such as your

attorney, but yourself will do). When you receive the envelope file

it away, unopened, until such time as you need to prove your point

and then only allow a judge to open the envelope. Certified Mail or

Registered Mail would work best for this.

I know of people that have done this but don't think a Poor Man's

Copyright carries much weight with the court. Usually a cease and

desist order, strongly worded and from your attorney, will get most

people to stop using your designs.
