Yes, this is standard "you must fail to get help" philosophy. It was very popular back when my oldest was in school. She is 25 yo now. You don't need to fail to get help. You do need to show the need for the help to get the help.

Data can be gained in a lot of ways. For instance, you can visit the school and take data. You can use the data from your therapies at home. Combining the two can show clearly that he learning X and Y skills directly from your home program and not from the school program.

Also, the evaluations that the school has done should be comprehensive and cover all areas of suspected disability and not just those related to the disability. It is likely that if they did the right testing, it shows the need for the things you want worked on.

Learn to take your own data and make use of it. Also, request outside evaluations to support your claim for services. If the evaluator can attend the meeting to help you advocate, that would be even better. Also, get an advocate to help you get the things you want on the IEP - call Ohio Coalition or locate people in your area who can help you.
