Guest guest Posted August 2, 2005 Report Share Posted August 2, 2005 I apologize I do not know your son's story, but just a couple of observations from one who has spent 5 years taking on a corporation larger than any drug company. First if your son was under 18 when prescribed you would be totally suing the wrong party in Wyeth. As an off label application they would have no liability. On any account you should name both all parties who prescribed and oversaw his care along with Wyeth. Even though the doc who prescribed doesn't have the deep pockets, he does have the liability for knowing all possible side effects and monitoring for all problems. If a percentage of liability is assigned by a jury, that doesn't mean the parties pay by that percentage. In other words, Wyeth may have to pay even for the doc's liability, but the doc should be held accountable. It is not okay to just prescribe based on what a drug rep supposedly tell him. It is his responsibility to educate himself, or not prescribe the drug. You also have a large hurdle in that the FDA forced Wyeth to water down the label warnings that Wyeth wanted on the drug. So it might be a good move to also name the FDA as a defendant. You have a very difficult path, I'm surprised you have found lawyers to take it on a contingency, it is no sure thing. Jim Well, we finally have jumped through every hoop and over every hurdle that Southeast Arkansas Behavioral Health Center could throw in front of us. They finally released my son's records and our attorneys have finished reviewing them. Within the next couple of days they will file the paperwork to launch a lawsuit against Wyeth Laboratories for pushing the poison EFFEXOR XR. I hope Wyeth loses it a**. I am fully aware that the lawyers get most of any financial settlement and I don't care. They are welcome to as much as they can get their grubby little hands on, as far as I'm concerned. I just think that it is going to take mountains of lawsuits, protests (like the one coming up in DC) and testimony (like that given before Congress in September 2004) before the dam breaks and the flood of horror that these drugs cause comes gushing forth and these people are exposed for the charlatans that they are. So, here we go down this track - kicking and screaming all they way unti! l we are heard and something is done. I've heard horror stories about how they come after you and find every dark secret, and talk to everyone who knows you. Well, bring it on. They will find scores of friends, teachers, coaches, neighbors and former competitors of my son in track/cross country/road racing who will tell them all about my son - the great and not-so-great - and how we supported him in all of his athletic, school and personal endeavors. And I'm so clean, I have never even had a parking ticket. We're not rich by far and we're not perfect - but we're no worse than anyone else and we will pitch a royal b**** if we've been wronged. The psychiatrist and the regional mental health center wher he is employed are also being listed as co-defendants, and he died before Wyeth asked for their " warning " and the FDA told them to water it down. Corey was cold turkeyed off paxil and onto a rising dose of Effexor that reached 300mgs the day he walked into school with a rifle. Corey was eventually found to be in diminished capacity because of these two drugs. You can find more on Corey at www.antidepressantsfacts.com click on casualties and scroll down to antidepressants and teen's who kill. Fortunately Corey did not hurt anyone. Corey is featured in a documentary that will be shown at film festivals this fall. It is titled, " The Drugging of our children " . produced by Nulls.
