I was told by a local attorney that I needed to wait until I was denied a second time before I hired an attorney. I've been out of work since Nov 2007 and money is certainly getting tight I wish there was a faster way to get approved!!! He recently had to have the arteries in both his thighs bypassed and understands the meaning of pain. I've had my back problem for 10 years on and off -- 5 surgeries later I still have sciatica pain -- guess it's never ending. This last surgery was supposed to fix everything. But guess what. I'm in more pain now than I was before the surgery!! The neurosurgeon keeps saying, " give it time. It can take up to a year for all the swelling to go down and the nerves to get back to normal. Guest guest Posted June 2, 2008 Report Share Posted June 2, 2008 Well I had spinal cord surgery to untether my cord in August of 2006...I now have nerve damage that will never heal....can't focus and work on medicines, can't focus and work off medicines...and my husband got tired of all the medical problems and we divorced in 2006...so I went from having a job that paid really well to a job with understanding bosses, but I am still not effective or efficient at my job anymore. Got my new MRI today and the dead spot in my spinal cord is getting longer, have some type of blood vessell tumor in a vertabrae on top of the typical bone spurs, bulging discs, et al....I just don't know how much longer I can go on like this and don't know how the heck to survive financially while being jerked around by social security....To go from where I have been financially to thinking of not working and living on public assistance makes me want to give up on everything... After a total of 23 years together my husband bailed leaving me with a toddler, a baby on the way, medical bills, rapidly deteriorating health, his VA loan and no income. His reason: " I want it to be the way we were in high school " i.e., no responsibilities and me taking care of him - and he was the one who wanted children! Not a day goes by that I do think of him and talk about karma? He died 2 years ago a broken down alcoholic with a prescription drug addict 3rd wife, supposedly of suicide though a cloud of suspicion hangs over the wife. Guest guest Posted June 2, 2008 Report Share Posted June 2, 2008 Amen to that! First thing I did before I started the SSDI process was retain an SS attorney, a local guy who is a former SS employee. I liked the idea that I could see this fella face-to-face as opposed to one of the national law practices. And the payment is 1/3 of my retroactive payment when it is awarded and after it arrives. So check it out. Unless you truly are a slam-dunk case (and I think those are pretty rare) I truly believe it is the way to go. Even then, it's no guarantee. Although mine told me upfront to expect to be denied at least twice and to have to go to the hearing where he believes we will prevail. Good luck! Re: Disability?Help/Long You say you need a lawyer but can't afford one. But lawyers that specialize in Social Security disability cases do not charge fees unless they win the case. If they win, they usually charge 1/3 of the amount awarded. I think it is generally recognized that these days, you need a lawyer. There is practically no chance you can win without one. As a single mom working as a teacher in the South, we lived paycheck to paycheck so I had no savings of any kind. The year before I was forced to go on disability, my father died of Alzheimer's. Since I was a state employee, my short term disability was a fairly easy transition since it was 50% of my regular pay and the payments were uninterrupted so I went straight from paychecks to disability checks. Transitioning from short term to long term however was not easy and I went from Oct when short term ended until mid-April without a penny of income even though the medical board approved me in mid-Nov. What got us through was a very large inheritance I got from my father, whom I had no idea had the kind of money he had tied up in investments, retirement accounts and insurances. So even from the grave my dad still watched over me, God bless him! I realize how blessed I was because I have heard an awful lot of sad, even tragic, stories over the years. I pray for all of you. She went to the Middle East with another man couple months befor 9-11-01. I was at home with the kids 6 & 13 they would cry and worry cause she didin't call from the land of sand for many days. I tried my best! She then came up with an Arabic tatoo that covers her whole back side. She can't even read Arabic! The slu% & ^%^ doesn't even know what her tatoo says except what she is told it says?! Real piece of work! Now that my health is fading all I get is legal challenges from her that cost money to defend. Because I have severely impacted cognition and memory issues I hired one right out of the gate but anyone can do so if they wish. Top paralegal all my med stuff and she was livid I got turned down even once! They said a utility shut off notice or a forclosure notice should hurry up the Judge review. I have both of those. I would have lost house by now if not able to borrow money from family! Not to mention fight for custody of my daughter to keep her away from ex's boyfriends son who was busted for drugs, at age 12!!!live in boyfriends son busted at 12yrs of age. Now that's real parenting!! My daughter wants to live with me but without SS Dis no way I could get her!! I'm in Georgia (Rome) and just sent in my appeal from my first rejection. I was told by a local attorney that I needed to wait until I was denied a second time before I hired an attorney. I've been out of work since Nov 2007 and money is certainly getting tight I wish there was a faster way to get approved!!! I do know that attorney's will take your case on a contingency basis and can only charge you 25% of your back disability and can take NONE of your future disability. I would search the internet for attorneys in your area that deal with disability issues! & gt; & gt; I was just turned down for SS Dis for the second time on May 28th. In & gt; the letter " I'll try and keep it short " they say. " You say you are & gt; unable to work because of severe back pain, spine impairment, & gt; degenerative disc disease, cervical spine impairment, multiple joint & gt; arthritus, headaches, other neurological disorders, other pulmonary & gt; disorders, hypertensive cardio disorders & amp; disease. Review of your & gt; file shows that you have been treated for these conditions and we & gt; realize the symptoms can cause you problems and limit your ability to & gt; function. Evendence also shows that although x-rays of your back and & gt; neck show DDD changes you maintain sufficient range of motion in your & gt; back and extremities. There is no evidence of muscle wasting or & gt; nerve damage. You are able to do light household tasks and take care & gt; of personal needs. Our orig decision was correct! Considering your & gt; age (50) education and overall condition you have the capacity to & gt; perform work simalar to your past job as a salesman/manager as it is & gt; normaly performed in the national economy. & gt; I had L4-L5-S1 fused in 2003 (6 screws and 2 rods) filed for & gt; disability after continued problems from surgery. Got turned down and & gt; went back to work as best I could. Constant pain issues that didn't & gt; abate and nerve damage in legs and feet from surgery (documented) and & gt; they say no nerve damage? I have electric type stingers in legs and & gt; feet. DDD in neck, 2005 many blood clots in both lungs almost lost & gt; that one!! 2006 started having severe headaches and electric stingers & gt; in arms. (C-Spine issues) Still working 50hrs a week and killing & gt; myself and NO SLEEP! April 2007 car accident hit a tree. Found tumor & gt; on my C- & gt; spine removed May 1st 07 (benign) Filed for SS Dis, I need my c-spine & gt; fused to stop symptoms, I am not going to get that done. I have no & gt; health ins, because I lost my job. Not enough disability at my & gt; company to recover from neck surgery. I had a grand mall (SP) seizure & gt; one month ago. Being carried to hosp had my left arm pulled out of & gt; socket. X-rays show perm damage (it was bad before but now left arm & gt; almost useless) I need surg on shoulder! Once again SORRY so long!! & gt; This is just a sipmle overview of my med condition. & gt; I was in Insurance and industry standards show you need to have 12-15 & gt; appointments a week to make a living! I'm lucky if I can to 5 a & gt; month! This is a commision only industry not hourly! There is NO & gt; guarantee of income even if you do work! On top of all this, my ex & gt; moved her boyfriend into her house. & gt; His son was just arrested for drugs!! My daughter (14) is at risk! We & gt; have 50/50 custody. She is exposed to this environment! I don't have & gt; ability financialy to fight for full custody!! They say it will take & gt; 2 yrs to appeal to an administrative law judge for SS Dis I will be & gt; homeless by then & gt; and who knows what will happen to my daughter!!!! ! 2 yrs, YOU HAVE & gt; GOT TO BE KIDDING! Do they think I'm doing this for fun or cause I'm & gt; lazy? These people are ruining lives! I want my money back and have a & gt; little relief. I worked 34yrs of my life and had no say in them & gt; taking my money! I need a lawyer but can't afford one. They said a utility shut off notice or a forclosure notice should hurry up the Judge review. I have both of those. I would have lost house by now if not able to borrow money from family! Not to mention fight for custody of my daughter to keep her away from ex's boyfriends son who was busted for drugs, at age 12!!!live in boyfriends son busted at 12yrs of age. Now that's real parenting!! My daughter wants to live with me but without SS Dis no way I could get her!! I'm in Georgia (Rome) and just sent in my appeal from my first rejection. I was told by a local attorney that I needed to wait until I was denied a second time before I hired an attorney. I've been out of work since Nov 2007 and money is certainly getting tight I wish there was a faster way to get approved!!! They have an extensive archive of documents, helpful hints and the moderators are SSI Disability lawyers and former Social Security examiners.
