ROCHESTER, MN (AP) - The driver of a semitrailer truck that hit and

killed a state trooper didn't see the squad car on the side of the road

until just before impact, Captain Graham of the State Patrol's Rochester

district said.

Cpl. Theodore Foss was killed Thursday along Interstate Hwy. 90 when

he was hit and run over by the Federal Express semitrailer truck.

Federal Express driver R. Tipka, 42, of Rochester has not been

arrested or ticketed in the death, but gave a statement to investigators

who are trying to determine what could have caused him to veer off the

road in good driving conditions.

"Mainly his statement says he never saw the squad car ... until just

a fraction of a second prior to impact, not enough time to hit the brakes,"

Graham said.

There was "no explanation as to why he didn't see it," said Graham,

who added that Tipka "did state that he had just changed lanes recently

and was checking his trailer."

Tipka changed from the left lane to a right lane, closer to where the

squad car was, Graham said. State law requires drivers to move away from

squad cars on roadsides, not closer to them, when possible, Graham said.

Foss was run over as he stood at the side of a minivan he had stopped

for allegedly

speeding on westbound I-90, about a mile west of the ton exit.

Tipka's semitrailer truck struck the back of Foss' patrol car, which

hit the minivan, and the truck ran over Foss as it pushed both vehicles

forward.

"We don't know if it was purely inattention or whether there was fatigue

involved," Public Safety Commissioner Charlie Weaver said. "Obviously,

part of the investigation will include a review of his work hours, so that

will give us a clue as to whether fatigue was an issue."

Lab results will be available within a couple of weeks and will indicate

whether drugs or alcohol were involved. But both Weaver and Graham said

the driver was coherent after the crash.

"We've taken blood tests," Weaver said. "We've taken urine tests. We've

interviewed him.

But it's too early to draw any conclusions. We haven't taken statements

yet from all the

witnesses, we haven't finished the reconstruction."

Witness statements have confirmed that the trooper and the van were

well off the roadway when they were hit, Weaver said.

Also injured in the crash were a couple and two children in the minivan.

They were taken to St. s Hospital in Rochester. The children were treated

and released. The van driver, Harper, 24, was in good condition.

Her fiance, Benac, 29, was treated and released. They are from Romeoville,

Ill.

Governor Ventura ordered flags at all state buildings to be flown

at half-staff to

honor Foss until after his funeral, scheduled for Wednesday.

His funeral is in the First town I worked as a paramedic in. They

are expecting more than 1000 law enforcement officers from the state of

Minnesota and surrounding states to come.

Would u guys believe that after my post concerning driving and meds, I got a

speeding ticket! LOL. I begged to be allowed out of the car cuz I was in So

much pain. He said 'no' cuz the road was too busy. I told him I was in a Lot of

pain and trying to get to the PT. He said pain not an excuse to speed. But he

promised not to show up in court so I could contest it and hope the judge would

reduce the amount. Meds never came up.
