Vivian at this point I would find me a lawyer to handle it from here. I believe

they keep the lawyer's in business (ha ha ha) I have only known a very few who

get disability on their first try. Just remember this is a very long process. I

started mine on Oct.23,2000 was my date of injury and I applied in april 2001.

Received my denial in 2001 aug. then received an oct. 2002 court date and reward

letter in Jan 2003 March 2003 I was suppose to receive my monies by then and

they have messed it all up and I still today don't have my social security

disability its on a backlog is what I am constantly told. I receive only 500 a

month because they thought I was getting workmans comp too. Ya right. It is not

easy to live on 500 a month, if it wasn't for my mother I'd be on the streets. I

thank God each and everyday. Just keep in mind it is a long process, so you

don't get discouraged. I didn't know how long this took, and thought things

would be over with by long ago and I'd be ok, well I have lost everything. I

believe they wait till they know you;ve lost everything, car, house, family,

kids etc. It is very SAD. Chris

Just got my Disability decision in todays mail. I was DENIED...which I

expected for first time filing.

It said that even though I said I was disabled from chronic low back pain,

disc tears, insomnia, and depression I am still able to go back to work doing

the job I was doing beforehand. As a paramedic, I don't know of any service who

will want to hire me! Not just with the bad back, but with the pain meds that I

am on!

It listed some doctors and hospitals that they received reports from...2 of

the doctors I have never heard of!

Sooooo...now what do I write in the appeals to make it a stronger case?

So it is like workers comp with the end result? Workers Comp want you to lose

everything and desperate enough to settle for peanuts.

Sorry to hear it was denied. As I said before, my " aunts " daughter

has cancer and she was denied disability twice also, they have no

heart there, they don't care about us wondering how we're gonna live

1. before getting disability and 2. when finally receiving it trying

to live on such a small amt. Get an atty, I'd suggest contacting a

center for disabled people in your area. They'd be really good at

suggesting an atty. I found mine by chance, friend of my sister-in-

law worked as a receptionist for my atty. My atty never asked for any

fees up front, said I'd pay her nothing, it would automatically come

out of my disability back pay, first check. My contract was to pay

her 1/4 which is well worth it.... some will charge 1/3 so make sure

you ask. As for the doctors mentioned on your denial, I wondered

about a couple also but they were doctors who read a certain test

(like MRI or Xrays) , if you have a copy of your test results it will

say the doctors name on there. I f I can help in any way please don't

hesitate to ask. When you choose an atty they will want every doctor

you've seen and will request reports from all doctors, all test

results, etc. My case too me 2 years.. I filed in Sept of 2000, won

my case finally in Sept of 2002 and received my first check (they

don't pay you all the back pay all at once, which I don't agree with

but nothing can be done about it) two weeks later. My case was

stalled for a month I think it was b/c they had misplaced my file...

I called my local congresswoman and a lady in her office kept tabs to

make sure my case was being worked and not sitting in a pile, so

consider that also. There were some questions about amts and it took

calls to a local social security worker who was very helpful

(shocking I know) and if there was a question, he'd fix it right

then. He could tell me exact dates of when a check would be deposited

(I chose direct deposit). I hope that helps!

Geez...I am going thru that now with my workers comp case. It was my WC lawyer

who advised me to apply for disability. He is in another state so I can't use

him for my disability case. Seems like for all the fighting I am doing...why is

everyone else getting paid when we are finally done?

I also disagree with Disability taking records from doctors who have never seen

me...even reliable tests can be interpreted in different ways by different

people. And I have seem my records where something I said or did was wrote down

wrong or in a lessser description than what I gave.

Something is screwy...and I am beginning to think it is me. Why else would I

give up a career that I loved, making $40k a year, a social life that was

extremely active, to sit at home and have " authorities " imply what a faker I am?

Vivian-

I've never had to do this before, but I've always heard that everyone is

turned down the

first time and most of the time it takes the services of a lawyer to help

get Disability.

I hope I never have to apply for disability, but if I do, I know that I will

be able to

get help from others that have walked this path before me.

Hi Vivian,

I think you got allot of good answers from the members in here. Just

think of the system as trying to shut you up. If you go away now

they win. If you keep coming back they will eventually approve you.

Either way they just want to shut you up. One thing with the meds

you are currently on how are you supposed to drive let alone work?

Exactly...don't these people actually read the applications?

And I agree with you, Nick...this is a great group and I have gotten some

wonderful advise. Already have the yellow pages out to a lawyer I am going to

call when I get home from my post-op check-up.
