The following information is from Dr. Lesley Fein, a well known and

respected doctor within the Lyme disease community. As you will

read, she is being investigated for over-treating and over-diagnosing

Lyme disease.

Below is information about Dr. Fein and her current situation. She

has graciously provided information to me in an open and honest

fashion. I find this honorable! Too many times doctors have wanted

the support of the Lyme disease community but refuse to let us know

what's going on. Dr. Fein is asking for money to help with her legal

expenses and specifically asking her patients for letters of

support. I know that this is a difficult time of year to find a

little extra money. It has been my experience that the medical

boards attack during this time of year for a reason: They hope

people will be so wrapped up in their own lives that they won't care

about others. It seems to me they are ignoring the entire concept of

Thanksgiving. If you could find $1, $2, $5 or more to give, I know

this could make a huge difference in the long run.

The information below is divided into four sections. The first is a

letter Dr. Fein sent to her patients explaining her situation to them

so that they would not be confused. The second section is the

answers Dr. Fein provided to some questions I asked of her. A third

section includes links I thought you might find helpful if you choose

to do some research yourself about this situation. And lastly is a

petition that can be copied and pasted into Word or similar program

and signed. Signed petitions should be mailed Dr. Fein's address

for yourself what an accomplished physician she is. I am confidant

that Dr.Fein will keep us up to date concerning her situation. I'll

TO MY PATIENTS

As most patients who have dealt with Lyme disease are aware,

physicians who treat Lyme disease in New York and Connecticut have

been subjected to investigations by the licensing boards in those

states. Sadly, the same is now true of physicians in New Jersey.

Opinion within the medical community is deeply divided regarding the

diagnosis and treatment of Lyme disease. (I have enclosed two recent

reviews for you to read.) The New Jersey Board of Medical Examiners

now appears to have taken sides in this arena. They have demanded 6

charts from my office which were reviewed by an Infectious Disease

specialist. On the basis of his review, The New Jersey Board of

Medical Examiners has filed a complaint seeking to temporarily

suspend my medical license. Clearly, this would effectively close my

practice forever.

I am determined to defend myself and your right to treatment. If the

New Jersey Board of Medical Examiners is successful at forcing me to

surrender my license, the vigorous pursuit of all other physicians

with a similar viewpoint will follow. Your ability to receive

appropriate treatment will be threatened.

I have been informed that the legal costs in this case will exceed

$50,000. I am unable to bear the financial burden this will incur. As

a result, a fund has been established on my behalf. I would greatly

appreciate your financial support.

Dr. Fein:

I am very well known to the Lyme community. If your patients go to LDF

conferences, they would know me. I was co-chairman with Fallon

at the most recent Annual International Conference on Lyme hosted by

the LDF. I have been one of their speakers and sat on their expert

panels for years. I have also worked on legislation and testified in

DC. My CV is at work and this is from home. I can attach it later. I

have published independently and together with Fallon, Dr.

Tilton and others. I have absolutely nothing to hide regarding my

charges now and have never done anything that would embarrass me

publicly. I am very outspoken against Insurance companies and

fight vigorously to get my patients expenses covered, I have had

letters written to the Director of BCBS in NJ by the Senate majority

leader informing them that there is bias in Lyme cases. I have

had " Lyme experts " removed from Lyme cases at BCBS because of bias.

Now, the " Expert " who was chosen by the board is an

insurance " expert " . We have filed a response to the AG's office

indicating our defense. We would benefit from any information linking

lyme experts and insurance companies to other actions

brought against doctors.

Question:

What charges are pending against you, Dr. Fein?

Answer:

over-testing

over-diagnosis

excessive use of antibiotics

inappropriate use of IV vitamins

Q:

How does the NJ Board of Medical Examiners function?

A:

they send charges to the AG office who acts on their behalf. if

charges are filed we fight it either with the board or in front of an

administrative law judge

Q:

How will letters be used to support you, Dr. Fein?

A:

I am NOT asking non-patients for letters! other patients can sign the

attached petition and send it to me or my attorney

Q:

How will money raised be used? Is this tax deductible?

A:

money will be used to help me defend my case. whatever is left over,

if any, will be donated to the LDF. I have no idea about tax

deductibility

Q:

How will the money raised be used in your legal defense? What about

Medical Malpractice insurance?

A:

My attorney is spending a huge amount of time on this. he hasn't sent

me a bill yet. Joe's [Dr. ph Burrascano's] case cost over

$100,000. I am already supposed to pay THEIR expert $8500. My

malpractice carrier may be liable for a maximum of $25,000 and will

probably dispute even that amount. Apparently cases brought by the

state are treated totally differently than cases brought by

patients. You would need to ask legislators why that is

the case

Q:

Is ILADS, the LDA, or the LDF, helping in some capacity? If not -

why not?

A:

The LDF is helping me in all ways but financially simply because they

cannot afford it. They do no fundraisers and really do not have much

money. The LDA, on the other hand, has lots of money. They are not

helping at all because Pat and I have had huge conflicts over

legislation in the past. I am receiving a lot of support from her

grass roots but she is scolding them for helping when she finds out.

PETITION

We the undersigned do hereby petition the New Jersey State Board of

Medical Examiners (BME) to stop prosecuting doctors in the State of

New Jersey solely on the grounds of their treatment of Lyme Disease.

We assert that the diagnosis of Lyme Disease is a clinical diagnosis

based on symptoms. Current testing is not accurate proof of infection

just as there is no test that can prove cure. There are, however,

many studies explaining the mechanisms by which the Borrelia

Burgdorferi bacteria evade antibiotics and evade the immune system

thereby causing chronic infection.

We further assert that the intention of the Board of Medical

Examiners to limit in any way the duration of treatment for Lyme

Disease is not supported by scientific data.

Dr. Rush, Washington's physician, predicted the

following. " Unless we put medical freedom into The Constitution, the

time will come when medicine will organize into an undercover

dictatorship. " We cannot let this happen.
