Under HIPAA you are legally entitled access to your medical records. Charts are

part of your record.

You are probably right about him not wanting you to see what his notes contain.

Doctors are very paranoid about lawsuits these days.

Has anyone ever had a doc tell them they can't have a copy of their

chart notes? Can they do this? I live in NW Indiana and want to

switch urologists as I have reacurring kidney stones and this doc

doesn't seem to think it has anything to do with Lyme. He gave me

all the test results but wouldn't release chart notes. Makes me

think that there is something in there he doesn't want me to read....

Thanks a, this helps. I am not looking to sue, just wanting everything

that is about me. At this point I just want some help from someone who

knows what they are talking about!

They gave me the test results, when I called to tell them I wanted them, I

asked what the charge was and they said there was none but that I would have

to come and get them. They wouldn't mail them to me because they said I had

to sign for them. I didn't want to drive to their office (it is in the next

town about 20 minutes away) but figured I would play by their rules. When

I got there they handed me the papers and said there ya go. No forms to

sign. I asked about the chart notes and I was told that the Dr doesn't give

those out. My reply? One more reason I am switching docs.

I didn't get refused but my past doctor wanted to charge me a fortune so my

present doctor is getting them for me. I don't know if they are allowed to

or not. My sister was allowed to go back and get all her records from when

she was a kid, as well as the rest of the family's records. Those records

were obtained from Pennsylvania, West Virginia, land and California.

Maybe your new doctor can get them for you.

My husband I just went through this monday when I requested his

records. The doctors office informed me that an attorney would have

to request the records. I am going to try again, stating our rights

with the new hippa laws and demand a copy. The office knows that we

are not trying to sue them, just trying to find out if we are

eligible for disability. I believe that we do have a right to them

and the chart notes. The office gave us notes previously to take to

another doctor. We read them and some of the stuff was not

flattering or supportive. Guess I should have copied them, didn't

know then that everything would be such a battle. Thanks for the

idea of the hippa law
