That's a good start, but it's not enough. You have to BE SURE you

complain (politely) to your military primary care physician to make sure

all this is in your official military medical record. It helps if you

have clinically demonstrable physical signs (joint swelling, dermatitis,

severe fatigue, morning joint stiffness, rashes, fevers, or anything

else you can demonstrate on a physical or laboratory exam). So if you

develop ANYTHING of significance, see your military primary care

physician. If you believe you're not being taken seriously, you also

have the right to ask for a subspecialist referral. Your fitness for

duty and your VA benefits -- particularly the service-connection of any

illnesses or injuries you incur while on active duty -- are ONLY

predicated on your military medical record.

If it's not in your official military medical record, it doesn't

officially exist. And if it doesn't officially exist, it won't reflect

on your fitness-for-duty or your service connection for VA benefit

purposes.

If at any time you believe that your physical disabilities significantly

affect your fitness-for-duty and ESPECIALLY your ability to deploy

world-wide, ask your military physician to refer you for a

fitness-for-duty MEB. This is your right! If it leads to a formal PEB

and the formal PEB offers you anything less than 30% disability and

separation pay (that is, at least the minimum full disability

retirement), TURN IT DOWN! That means they've discovered something

significant that could affect your fitness for duty, and they want to

get rid of you before you can build a good case in your favor. So if

you're sick, stress the system! Even if you don't get everything you're

entitled to (and chances are you won't), you'll generate a serious paper

trail of military procedural errors that will serve the basis of an

appeal to the Federal Courts.

While I'm thinking about the Federal Courts, START SAVING MONEY for your

own personal legal fund while you're in the military and earning an

income. I know that if you're not earning much to begin with this won't

be easy, but considering everything you have at stake, you can't afford

not to get ready to fight the military for what is rightly yours.

Cancel cable. Eat in. Don't buy anything you don't absolutely need

(which is anything other than food, rent, and utilities). Whatever you

have to do, put away whatever you can in your personal legal fund. (A

number of us -- including me -- are doing what we can to set precedents

in the Federal Courts to make it easier and less expensive for those who

come along later, but you'll still have to pay your own way when the

time comes.)

Remember, if your health problems aren't in your official military

medical record, they don't officially exist! And if they don't

officially exist, you can't use them for evidence in support of any

claim you might have against the military or the VA. Neither the

military or the VA will give you what is rightly yours without a real

fight, and you have to have official documentation to support your case.

You can't prove the military was in error when there's no evidence that

the military knew you were sick! And the military won't know if YOU

don't tell it by documenting it in your medical record! (Have I

emphasized that enough?!)

I'm writing all of this from my own experience. If my experience is too

specific or is not the optimal strategy, then I invite others to correct

my recommendations to more closely reflect reality. But what I've done

(as I've outlined here) has served me well so far. (I have an

extraordinarily well-documented case. The military isn't fighting me

right now on the facts of my case but on whether the Federal Courts have

jurisdiction to do things the military didn't do and that the military

maintains only it can do. This is obviously a key point. We have

statute and case law on our side, but it's taking time to prove it

because the court dockets are congested. When we get past this, proving

my case in court should be much easier. And we will have solved this

problem for others who come along afterwards. But I digress.)

One other thing if you accept any form of seperation bonus, and then go to the

VA to attempt to increase your disability, be aware the VA will withhold any

payments until they have recouped the bonus amount.

Thank YOU and all those at Dover! It was Sonnie Bates's " 60 Minutes "

segment (Jan 2000) that clued me in to what I'd gotten. I got the shot

on 24 Sep 93, but wasn't told what I'd been given (in spite of my

telling the tech to do so), and the tech handed my shot record back to

me without annotating it. I got sick less than a year later. I had no

idea what it was until you all came through for all of us.

Took my 4th shot last nite all I ant to do is sleep, but I feel ok!! I am genotype 1, stage 2 starting at 1.2 million viral load. AST and ALT 140, 149

I am on:

5 capsles of rebetrol

1 injection of pegintron

for 48 weeks

During my 4th week (next week) I start taking my protease inhibitor for 44 weeks.

Dr. Schiff is my doctor and I love him.
