In CA, it is age 6, so if he is only 5, he would not be subject to compulsory education. Second, if it is written into the IEP that he has one day per week of at-home education/therapy, then he would not be subject to truancy, because he would be attending school at a different location that day. Guest guest Posted January 9, 2009 Report Share Posted January 9, 2009 Hmmm. You need to also check out those truancy policies for your state/county to make sure the principal is correct. Most truancy policies I have read are not that specific and apply only to absenteeism which in your case would not be as he will be receiving instruction at home. When I homeschooled last year, our school system did not say a word to me. When my daughter started back this year, I had it put in her IEP that she will have half days Mondays and Wednesdays for therapy. I also had it written in that she would be finishing her Tomatis therapy the first semester of school and so she was out for 2 weeks but they did not mark her absent. So, I would get an advocate and request an IEP meeting ASAP. It would probably be good if you can get a representative (prefereably Psychologist) for the ABA comopany you are working with to attend the meeting with you. S.
