Most schools serve the people living in their district. If you go to another district, you would have to pay a fee. And not all schools accept out of district students. It would be harder, I think, for a special needs student to transfer because it's going to cost them more money to provide services. I would not want to circumvent the rules to get my kid into a school. If you move to another district, then you can put him in another school, obviously. After careful consideration we have decided to pull our boys from the district and move them to another district.... We live in an area where there is only one district, we would like to move our boys to another the problem is it is the law now that we have to physically LIVE in the district, We have gone to 2 different districts and tried to put our kids in (we have family in those districts) WELL she thinks she is queen and has called each district once the records release has gotten to them and told them we do not live in those districts thus making us have to prove we do!!! SERIOUSLY??? she is going to do everything she can to MAKE us go back....I WILL NEVER STEP FOOT THERE EVER AGAIN!!! isnt this technically harrassment?? We are going to move in with my parents in the area of a school and then live in our beach home on the weekends (its a home that has been in the family for years and we dont pay an outrageous rent amount) I have every intention on hiring an attorney for what she has done with my son and the drive is EVEN LARGER at this point...can anyone guide me in the direction I need to go?? It is the law, I believe, that a district cannot deny acceptance of a student based on a disability or an IEP because of money. It's just not legal. That being said, there are other ideas for Raina. Homeschooling was one she mentioned. There are also other private schools. I do think consulting an attorney to see what they think is a good idea. The statement above was not meant to frustrate you; just to clarify that portion of what you said. Thanks. You think it's harrassment for the principal to say you don't live where you're trying to enroll your children in school? It's against the law to lie about where you live to get your kid into a different school. I haven't seen anything illegal here. In my opinion, it would be a huge waste of money to hire attorneys.. Get the paperwork from the District you'd like them to go to and they will tell you all the rules. We did this with a Virtual School. Good Luck. Here in my state, you can have school choice if you attend an under-performing school. And in some places, you can't automatically transfer into a school unless they have the space available (if it's outside your own district.) Definitely find out the details. If you have schools with a transfer policy, I still think it would be harder to move a sped student. many times, admittance is based on spots available and I doubt there are a lot of open spots for sped kids since they are all individualized and cost money. If you mean your own district, obviously, they have to take all students, regardless of needs. But when you transfer, a lot of times they can pick and choose. We have inter-district open enrollment here and they don't have to take any students. If you want to go to a different school within our district, you have to apply and see if they have room. I can't see them lining up to take a student who will cost them money unless they have places available in an existing program. Guest guest Posted December 7, 2010 Report Share Posted December 7, 2010 I feel like I need to clarify, ok We are now IN district as we packed up our 6 boys and moved in with my parents in a tiny 2 bedroom house till we can find something else, just so we could be in the district and not get into trouble...The principal is still insisting we live at our beach home when in fact my husband is just staying there 3 days a week while he works close to that home.. We had no choice as the old school was denying my son an education, as even with a 299.0 diagnosis of ASD they felt he did not need to be evaluated and when in meltdown mode (head down on desk) they would call me to come and get him and told me they did not have anyone educated on how to deal with him and that he was basically unteachable...he is first grade and incredibly behind..missed 45 days of kinder last year.....SEE why I so desperately wanted to move instead of the principla calling me and asking what they could do to get all 5 kids back in her school she resorted to slandering me as well as calling and making up all out lies about my son to the new district as well as said we were not living there and in fact had spies drive by (the woman is relentless) At our district in WA state kids with special needs get the school MORE funding so in fact in benefits them to take the SPED kids. I am happy to report that today was ashtons first day of school and when I walked in the door the principal, SPED teacher, his teacher (a good friend of mine) and the superintendent...We had a meeting and discussed a plan of action as he was very disturbed at the old district and how ashton was sooo terribly neglected! We took have a horrible district and in my case the Principal of our problem school has family all through our district, so like yours she spread the word. I am about to hire an attorney too I think. Fincances are holding me back though =( My first thought (and this may be different in other states) but here in Mass we can do a “choice” and go out of district but then each other school can limit the amount of out of district placements they accept and they do not have to transport. I am guessing you don’t have that option there? You are lucky to be able to move in with parents and you are a good mom to not allow them to push you around. Although I did not read the string on the condescending emails from teacher, I saw them and shook my head. I have been in crisis with mys on, so I have been unable to read/reply to much on here. But it does not benefit them to take sped kids at all - this is not a money maker. This is because they only get a percentage of the cost to educate these kids. The gov't is only funding a percentage of the mandates for sped. They would also have to show that they are providing services for the kids they are getting funding for. So this is not something they are making money on, and they are not begging sped kids to move in a district anywhere. If you moved, then move the kids to the new school and be done with the evil principal. She can complain all she wants but once you have moved to another district, she is going to be out of the picture. I don't know why she would be arguing. you'd think she would be glad to have you all out of her hair.
