Guest guest Posted January 4, 2007 Report Share Posted January 4, 2007 Hi, I just moved to Westchester County, NY, and found out about the unbelievable situation in NY regarding religious exemption. Parents are required to explain in an affidavit exactly WHY their religious beliefs are against the vaccines, are put through inquisition by schools to prove otherwise and their whole lifestyle can be put under scrutiny (parents were questioned, for example, about the toppings on their other children's ice cream...). If anybody here succeeded in getting through this without hearings and courts, please let me know how. I'm in the Katonah - boro disctrict. Please email me privately to tamitamir@.... They cannot according to our state public health law question you on your religious beleifs in regards to your exemption. You do have to follow the state law which requires you file a notarized exemption letter. It should include the proper wordings and refer to the law and it's exemption clause. You provide this letter to the district. They cannot legally refuse your child or they can be sued! For violating your rights. Are you sure this is not a scare tactic by others in your district to get your to comply with vaccination? Many times school officials will feed you a load of bull to pressure you into vaccinating. I will post a link for this site for NYS and exemptions. It tells you exactly what and how to file. And how to protect yourself and your rights. If there is still a problem, you need a laywer because what they are doing is baring your child from their education and they cannot do that if you are following the law. You are going to refer to Public Health Law 2164 Sub. 9 in your letter. this applies to day care, nursery school, private school, kindergarten, elementary, intermediate, or secondary schools. Sub. 9 says that 2164 does not apply to children show parent, parents or guardian hold genuine and sincere religious beleifs which are contrary to the practices herein required, and no certificate shall be required as a prerequisite to such children being admitted or received into school or attending school. The law also goes on to say that no one can question or request proof you your beleifs. http://vaclib.org/exempt/newyork.htm Don't be intimidate! You can also get a medical exemption based upon your child's immune system being too weak to vaccine or allergies or previous negative reaction to vaccines.
