new jersey is one of the states that requires coverage. Here is a link

I'm in Georgia, if you're asking me :) The lady that called yesterday from the insurance company to tell us Noah was denied said she thought it was the aspergers diagnosis, since he doesn't have bipolar like his brother but they both are aspergers(anxiety,depression) and Noah is OCD whereas n is bipolar.

GA from what I can find on the net (have to see if I can get a buddy of

mine to email me some other stuff to get more info) was one of the first

to make it mandatory to cover persons with autism/spectrum

disorders/pervasive developmental disorders. If they are saying its

pre-exsisting, then there are loop holes for that. If they are just

saying no they wont cover anything for therapies/treatment (wrong word,

but its the one they will use) then tell them that you are appealing and

you will be getting a lawyer and going to the insurance commision (no

you should not have to get a lawyer, just tell them you will.) Tell

them that Asperger's is part of the Autism Spectrum and is a Pervasive

Developmental Disorder and that by law these are to be mandatorily

covered in the state of GA. Advise them that if they continue to deny

coverage of services and do not pay for services already done, you will

continue to notify the insurance commision and will be seeking damages

through the court system. Let me tell you ALL insurance companies jump

and will try to give you anything to keep from dealing with the

insurance commision and attorneys. The ins com will tear them apart,

and not only go over your case, but will evaluate every member that has

coverage through that insurance company (talk about paper work). The

more errors (read as the more times they break the law) the higher the

fines and the more chance that the company will loose their license in

the state. (the fines are high to begin with, but the more errors, well

lets just say they can and will cause bankruptcy for the insurance

company). As for the lawyer part, if its needed then do it, but it

shouldn't be needed. If it is, well just sit back and watch the fun.

The lawyers tend to ask for payment of all bills in full, and then

excessive monetary damages for the family due to stress and loss of

income/ change in living conditions/life status etc...

Have to be enrolled full-time in college.>> My understanding is that as long as they are in college they can, but my kids have been out of school (except for GED prep and test) since last year...and they just turned 19 on Oct 19 and they aren't in college so we have to pay until they go to college. I guess they have to take a full load too, does anybody know if they cover even if they are unable to take a full load? that's my next concern..always something for me to worry about lol, Toni

Thanks for trying to come up with other options :) That's why I love being on these lists, everyone tries to help each other so much..I think right now the plan is to appeal and to apply for SS and take them into the the office, last time the interview was over the phone. The 4 of us are going in, Kerry and I will hand them all the paperwork I have collected (including the insurance denial and all the emails about them not being able to attend school etc) and let the interviewer talk to them. When she asks them questions and they don't answer or don't know maybe they will see that they really have problems. Especially if n sits on the floor again...I'm not going to answer any of their questions and I'm going to kick Kerry quietly if he does. We'll see how that goes... Thanks again... Toni

and medicaid and the likes say no because they live with you or because "they are not severely disabled" Im so sorry. This is why I got out of insurance. Tony, you are so well spoken in your responses on the list. Don't be

nervous about speaking up...you are the " expert " here because you

live with it 24/7. These people with a bunch of alphabet letters

after their name do not live it all day, every day.

Maybe you could request a " pairing " with another parent at the

school thru office of disabilites to help you advocate for your

children. It is very hard to stand up to a room full of " experts "

all by your self.

Dang Sue , you made me tear up..I sooo appreciate YOUR encouragement. I think my mom would be a good choice , she is very well read and can talk to anybody about anything and never meets a stranger, I hate to drag her in her wheelchair (she broke her foot yakking, lol), then again maybe they would feel doubly sorry for me and offer all kinds of help.
