As to whether to request testing, ask now and don't worry about how the dates stack up. Put it in writing always and CC copies to those higher up the food chain when you feel you will get the brush off. You can even mention, " I asked last october but I was told...blah blah blah " to document that you did already ask previously. They are not requiring summer school if he is only failing one grade which is the case right now but there are 2 more grades very close behind...so I am worrying... If you have him tested, you can put him in speical ed/ support classes for those classes he is failing/failed, and they cannot require him to go to summer school or repeat a grade.
