We are in the same situation. Can you forward any information you find over the

legality of being asked to come pick up a child. We have and IEP under autism

and the school isn't following the behavior plan, instead riling him up when

upset to the point of disaster, then calling me.

Anyone know any legal quotes that I can use at tomorrows IEP meeting.

( ) Here we go....Again

When we had the MDT meeting about two weeks ago we thought we had gotten it

across to the school that it would not be ok for the school to call us and

come pick up our son from school. Yesterday the school called and said that

we needed to come talk to him or take him home. Once I talked to the

principle who said they could do this when he didn't have an IEP, but now he

has one. The reason we had to come get him? He wasn't doing his

schoolwork. The school psychologist is really getting on my last nerves.

He actually said to my husband he wondered what would do if we put him

on a placebo instead of his regular meds. He still is insisting that

has emotional problems and is not Aspie. I found this great place online

(MAAP) that states a few things I am going to read to the school on Monday.

And I think I am going to have to get upfront and tell this guy he is not a

pediatric physician and that one has diagnosed him as Aspie (One that has

seen for a year and a half.) I called 's therapist and advocate

yesterday who both said that the school definitely can not ask us to pick

him up now since he has an IEP. Thank for letting me vent.

Thanks..... We have had the functional behavioral analysis and a level I

behavioral support plan that they did not follow the day they called to have me

pick him up. Any and all legal ideas would be great to quote to make my point

loud and clear tomorrow.

Yes, your child is being denied FAPE (Free Appropriate Public Education).

Coming to get them in the middle of the day is not appropriate education. If

the school district has such a bad handle on the situation that they have to

call you weekly to come and pick your child up, a Functional Behavior

Assessment would be an order. Pam :)

you could resort to filing a state complaint on the basis that the

school district is not providing your son with FAPE (Free Appropriate Public

Education). The disruption of them calling you to come pick him up in the

middle

of the day is denying him FAPE. Pam :)
