I did mine right at the beginning of December 2005 and they are having the meeting on the 23rd of December for one of my sons. Look up online the Idea Law. It is a great resource. Mommy to - 9 - Aspie - 8 - ADHD I have a question, I had a meeting with the school district psychologist and signed consent to have my son evaluated. They have 60 days to comply. This was signed on November 14th. Is it up on January 14th? Is it business days only? Anyway he has not been evaluated and I want to call the state when they are out of compliance and I am not 100% sure when that is. The sad thing is I work in my son's school and in special needs. Guest guest Posted January 12, 2006 Report Share Posted January 12, 2006 Write a letter to the director of Student services and tell them as of July 2005 the law states 60 calendar days to complete the evaluation and meet to discuss it's results. Tell them your sure they were unaware of the change and would definitely want to stay in compliance. Therefore you are requesting the date be kept in the 60 day time frame. (At least in New York) Check your State Education Dept website for a link to your State Education Law. There should be a whole section on Evaluations. I have been in contact with them and they are telling me that the district psychologist is behind and they are looking into outside resouces to get my son evaluated. Even though he has a diagnosis from two different doctors. I have emailed them and already told them I will be calling the state on Tuesday. It is ridiculous. I have had to make them copies of his records numerous amounts of times. I think it is because I work there,they think they can get away with this. Well they are in for a big surprise. I worked there because he struggled everyday. We had no idea what AS was. Once we found the right doctor and found the correct diagnosis, I read as much as I can on IEP meetings, IDEA and Special Education services. You are correct. They have 60 days after the consent was signed to be in compliance. I don't think that is consider 60 " school days. " But that is just my opinion. I would contact the State Department of Educaction for Exceptional Children in your state. The sad thing is there is nothing under IDEA that I have found that gives a time constraint to when a consent form is given after a parent requests an evaluation. We waited four months to get a consent form after I requested an evaluation. So, at least you are on the right track. Personally, I would write a letter to the Special Education Director, reminder her of the date you signed the consent form and inform her that we are soon approaching 60 days from the date the consent was signed. Ask her to respond with a date in which your son/daughter will be evaluated. Also, try to avoid phone conversations (for the most part). You want everything in writing. Hope this was helpful. You need to really consider your options and in the process, look at the long term. You will be having a relationship with these folks for a long time. And they will be working with you to design an appropriate educational plan as well as providing services. I really recommend you find ways to work with them, be accommodating when possible and choose your battles. You can always record this violation in case you need to file due process at a later time.
