Guest guest Posted August 20, 2003 Report Share Posted August 20, 2003 I just received a call from the Social Security office and was told that my SSD was going to be approved without a hearing. She said the judge found it ridiculous that it was not approved to begin with. She said the judge said I had more than enough medical information to document that I am disabled and unable to work on any job. They will send me a work affadavit that I will have to sign saying that I have not worked since I applied for SSD (March 21, 2003) and then they will complete the processing. She said it may take a couple of months before they complete the processing because they are moving to a new office but for me to rest assured that it has been approved and there's nothing more that I need to do. She said that the judge always reviews the cases that are sent in for appeal to see if there is enough info to go ahead and approve it without a hearing because it saves them both time and money if they can avoid a hearing, plus gets it approved much quicker for the recipient. She said if I'd had to have a hearing it would be at least a year before the hearing! She told me that when the case is sent in for appeal they look at it fresh - regardless of what the initial case worker decided on the case. She said you would be suprised how often the initial case worker ends up denying the case when the person is so gravely ill that there is no way they will ever work again. She said they had one case where the person had cancer in 5 major organs and the case worker denied the SSD saying the person would be better in 12 months. She said they had it in writing from more than one doctor that the person would most likely be dead in less than 12 months. Needless to say, the judge approved the SSD immediately. I told her that I was fighting for the cause as much as for myself. I am in a position that I have the time to fight for the SSD and I was determined that I was not going to have a lawyer getting part of my money. As we all know, most people fighting for SSD are in dire straights financially. I feel that the lawyers take advantage by making people think you can't get the SSD approved without a lawyer. I had no doubt that I would get it approved without the aid of a lawyer but once it was initially denied I did think I'd have to fight harder and have to have the hassle of a hearing. I'm thankful that they do have a system where the judge takes a look at the case and decides if a hearing is necessary before they just automatically push it aside for a hearing. Now if all judges were like that. I have my SSD but I think the major reason I have mine is because my mom and the doctors pushed it through because I was so sick last year and they didn't think I was going to make it at one point. Like I said we need more judges like the one that was on your case because then we wouldn't have everyone waiting forever for something that they need when they can't work anymore.
