Very interesting article and well written...

To play devils advocate here...

Finding her guilty would mean that IF a Dr sayes you need a C-section and

you can't VBAC and there are complications during the VBAC and the baby dies

or is brain damaged... does that mean we can charge EVERY mother who goes AMA?

According to the studies..Dr's aren't right all the times... and it is true..

that in the US C-Sections are done at an alarming higher rate.

Which is most likely caused by epidurals and labor not progressing...

She wasn't full term... and in essences the Dr's were suggesting terminating

the pregnancy early.. of course with the hopes of delivery and the children

surviving... not terminating life.

I will say for the record that I am Pro Life/Pro Choice.

I don't believe abortion is 'right " .. but We have Free Will.. and what we do

with our bodies is OUR choice. I am sure such decisions are not made lightly

and what I believe is exactly that. I have no right to force those beliefs

on others. :)

That being said.. I resent government telling me if I have a choice or not.

Right now I am pregnant AMA -- but refuse to abort.

If for some reason my child is born deficient.. because I am pregnant too

soon after RNY...

am I to be prosecuted?

Right now we take away babies from moms who are born FAS / drug addicted...as

that is obvious.. but where do we draw the line?

Now we put a women in jail because she refused a CSection pre term?

This case could have some serious reprecussions...

No, because you are of average or higher intellect. I think the key

issue is the fact that she is mentally

deficient/slow/retarded/cerebrally challenged etc.

She needs *someone* to make informed decisions for her from what I've

read, because she is mentally uncapable of doing so.

Then why didn't the hospital go to court to force her to have the c-section

is they were so concerned? Or why didn't they commit her? I don't understand

that part of this. If everyone (hospitals and such) were saying she was not

competent, there are mechanisms available to take care of that. Rather than

charging the woman with murder because she was not mentally competent to

make the decision, why are the hospitals not being charged with failing to

do their duty? Not a criticism but just questions dear.
