Guest guest Posted March 12, 2004 Report Share Posted March 12, 2004 Following this line of reasoning.....What about a mom who has lost her mucus plug and her bag of waters has broke and feels it is critical to preserve the life of her unborn baby that she get a c-section immediately, but the OB says that it just isn't necessary at this point and she should wait it out. Then, because the doc choose to wait against the mom's wishes, the baby is finally born, but has died. Should the doc be charged with murder or just malpractice? A C-section for a woman with VIABLE children is NOT only treatment for her. I am not arguing the point of abortion, which is a woman's right to do whatever she chooses for her body while the child is not viable (Which I do not personally believe in because the child WOULD be viable if you chose NOT to kill it.....but if it's legally your right it's your right)...but once the child reaches viability it no longer is just HER body, it is a body that belongs to both her and another, or in her case, two other human beings. I do agree that it is perfectly okay to choose what treatment you feel is appropriate for you and/or your children at any point provided they are rational decisions. The decision to flat out say " I would rather my child die " makes it criminal to me. Most parents make decisions based on the well-being of their children, the decision to allow your child to die rather than undergo surgery to me has nothing to do with the well-being of your child and therefore not a " medical decision " . Guest guest Posted March 12, 2004 Report Share Posted March 12, 2004 This was on Oprah and if I remember correctly, the hospital was found liable, but I'm not sure the individual doctor was charged. The sickening issue with this is that the woman's original OB was on vacation and when his substitute call him for direction, the original OB basically told him to do nothing until he returned. He wanted the claim to fame in being able to state that he had vaginally delivered the first twins in that hospital to a woman over 40. She and her husband begged the OB on the floor to do the c-section, it was even in her chart from her primary OB, but the dumb doc wanted to wait. One of the boys ended up with severe cerebral palsy and mentally impaired because of damage done by waiting, luckily the other boy was ok. I had a church acquaintence in Utah who's pregnant girlfriend (the child was his) wanted to get an abortion and he took her to court and successfully garnered custody of the fetus. Today, London is a happy and healthy 15 year old. If we are going to make laws like this you can't pick and choose where and when you are going to apply it, there needs to be some sort of uniformity. I'm not saying at all that I agree with what this lady did, I think it was awful. But on the other hand, laws like this are difficult because you get prosecutors who start to use a law in a way it was not intended to be used. In the article it says the law was written to prosecute pregnant women from using illegal drugs and harming their unborn child. This prosecutor is using this law to apply to this lady and thats not what the law was intended to do. And if he/she is willing to misapply the law, what is to stop it from being misused in other cases. Axelrod Re: Re: OT - Did anyone see this in the news? I'd really like to know how they can charge anyone (mom or doc) with murder in any of these cases but allow abortion to continue. If they call this murder, then abortion is certianly murder...premeditated. I'm not talking about the abortion to save a woman's life...but the one where it's mom's 7th pregnancy and she's only 19...and 7th abortion as well. Who's standing up for all those babies?
