I worked for Pacific Bell when I got sick and this disease came out of remission. I'd only been with them for 3 yrs, and fortunately had marked the LTD box and started paying my $6.00 per paycheck into LTD. The company paid my STD for the first 12 months, then fought me tooth and nail about LTD for the next 6 months. However, they required I apply for SSDI and the same day that SSDI approved, my STD ran out- and since they'd been fighting it--and lost--- they automatically approved the LTD--rather than waste the money redoing the exact same tests that the STD people ran. Naturally your company doesn't want to have to match or pay up to whatever percentage (usually 50 - 60% total of what you made working)--and SSDI is 25% of that total-- so they'll fight you. Get it going-- and if they start hassling you-- get a lawyer for the LTD portion. Also, if you have a union--get ahold of your rep and get them going on this. I will be pushing my company this week as the have had three months do to their research and I have provided them with all of the medical records that they have asked for. It is now time for them to make a descision so that I can move forward. What I do have in my favor is that I am over 50 and several years ago they denied a co-worker LTD. He fought it and won after goin to court. My claim is very similar and I have medical tests that substaniate that I have neurosarcoidosis. Spinal taps, MRI with white matter, and Phsyc test that show that I have loss in cogniate thinking ablity above marked performance, which causes me to have to take frequent breaks and would be very disruptive to my job. That is why SDDI awarded me disability benefits. These tests were verified by two neurologist and phsyc doctors. I don't know what else they need or want. Hopefully I will find out this week. I was approved for SSDI on my first try. I was denied LTD originally...I got a lawyer specializing in ERISA cases, and after a year, finally won. I was on COBRA originally, then once awarded LTD, began receiving company benefits once again ... I am "supposed" to receive LTD and corporate health benefits until age 65 ... however, these insurance companies just do not want to pay, so I am sure that they will stop my benefits at some time in the future. My doctors have told me I'll never work again; I like to think otherwise, but it's going to take my doctor's signature to allow me to return ... and he's not budging on this. Now that I receive company health benefits, I still pay for COBRA dental ... and I just received notice that those benefits will end in May. I called them and was told that I was supposed to have called them and send them my SSDI win letter. No one! informed me of this ... even though I spoke with them many times when I was changing from COBRA health to COBRA dental only ... they told me that I should have read this info on the back of the SSDI win notiifcation ... I am really annoyed about this. You know, no one really tells you anything ... it's not like we know all the rules as we've not been down this road before.
